Provisions for Promoting and Regulating the Cross-Border Flow of Data
促进和规范数据跨境流动规定
Ordinary employee information may be transferred abroad without restrictions.

Article 1: These Provisions have been formulated for the purpose of implementing the systems for overseas1 data transfer such as the security assessment of overseas data transfers, standard contracts for overseas transfers of personal information and certification of personal information protection in accordance with the PRC Cybersecurity Law, the PRC Data Security Law, the Law on the Protection of Personal Information and other such laws and administrative regulations in order to safeguard the security of data, protect the rights and interests in personal information and promote the free flow of data in a lawful and orderly manner.
第一条 为了保障数据安全,保护个人信息权益,促进数据依法有序自由流动,根据《中华人民共和国网络安全法》、《中华人民共和国数据安全法》、《中华人民共和国个人信息保护法》等法律法规,对于数据出境安全评估、个人信息出境标准合同、个人信息保护认证等数据出境制度的施行,制定本规定。
Article 2: A data handler shall identify and report key data in accordance with relevant provisions. Where data have not been notified or publicly issued by a relevant department or region as being key data, a data handler shall not be required to file for a security assessment of the overseas transfer of data for such data as key data.
第二条 数据处理者应当按照相关规定识别、申报重要数据。未被相关部门、地区告知或者公开发布为重要数据的,数据处理者不需要作为重要数据申报数据出境安全评估。
