These Provisions have been formulated pursuant to laws such as the PRC Civil Code, the PRC Seed Law and the PRC Civil Procedure Law, and in light of adjudication practice in order to correctly try dispute cases involving the infringement of rights in new plant varieties.

为正确审理侵害植物新品种权纠纷案件，根据《中华人民共和国民法典》《中华人民共和国种子法》《中华人民共和国民事诉讼法》等法律规定，结合审判实践，制定本规定。
