Second law draft of personal information adds articles on personal image capture and contract rescission

Issued: April 29, 2020

Main contents: The installation of image capture or personal identification equipment in a public place shall be done solely if required to safeguard public security, shall comply with relevant state provisions and be indicated with prominent signs. The personal images or personal identifying feature information so collected may only be used for the purpose of maintaining public security, and may not be made public or provided to third parties, unless the separate consent of the individual is secured therefor (Article 27).

Where an entrustment contract that has not entered into effect, is invalid, is rescinded or terminated, the contractor shall return the personal information to the personal information processor or delete the same, and may not retain it (Article 22).
