CNIPA defines irregular patent filings

Promulgated: March 11, 2021

Effective: as of date of promulgation

Applicability: For the purposes of these Measures, the term "irregular patent filing" means an act by any entity or individual, either individually or in conjunction with others, of filing various patent applications, acting as an agent in patent filings, transferring patent application rights or patents, etc. that is not carried out for the purpose of protecting innovation and is not based on genuine invention/creation activities but rather for the purpose of seeking illegitimate gains or falsifying innovation results or service performance (Article 2).
