Guidelines on Application of the Leniency System in Horizontal Monopoly Agreement Cases

Article 1:   Purpose and Basis of the Guidelines

第一条 指南的目的和依据

Pursuant to the second paragraph of Article 46 of the PRC Anti-Monopoly Law (the AML), if a business operator proactively reports to the State Council's anti-monopoly law enforcement authority (the Law Enforcement Authority) relevant information on a monopoly agreement that it has reached and provides material evidence thereof, the Law Enforcement Authority may, in view of the circumstances, reduce or exempt the business operator from penalties (the Leniency System).  These Guidelines have been formulated pursuant to the AML in order to guide the application of the aforementioned provision in horizontal monopoly agreement cases, enhance the transparency of the work of the Law Enforcement Authority and facilitate applications for leniency by business operators.

根据《中华人民共和国反垄断法》(下称《反垄断法》)第四十六条第二款规定,经营者主动向国务院反垄断执法机构(下称执法机构)报告达成垄断协议的有关情况并提供重要证据,执法机构可以酌情减轻或者免除对该经营者的处罚(下称宽大制度)。为指导在横向垄断协议案件中适用上述规定,提高执法机构工作的透明度,便于经营者申请宽大,根据《反垄断法》,制定本指南。
