China's Civil Code Expands Personal Information Protection, Strengthens Contractual Protections

On Jan. 1, 2021, China will see its most comprehensive law come into effect. The PRC Civil Code (中华人民共和国民法典) will have massive implications for business operations, from expanding the scope of personal information protection to introducing new contractual rights and obligations.
"A code or codification is a systematic combination of the legal provisions of a legal field in a uniform body of law," explained Ulrike Glueck, Shanghai managing partner and head of corporate at CMS. "This should in principle exclude other sources of law in the relevant area and conclusively regulate the respective area of law, in this case, China's civil law."
