These Provisions have been formulated pursuant to laws such as the PRC Patent Law and the PRC Administrative Procedure Law, and in light of adjudication realities in order to correctly try administrative patent grant and confirmation cases.

为正确审理专利授权确权行政案件，根据《中华人民共和国专利法》《中华人民共和国行政诉讼法》等法律规定，结合审判实际，制定本规定。
