Legislation roundup: Cybersecurity review, data security, and economic and technology zones

CAC lists the conditions when a cybersecurity review is required, push advertising should offer online users the option to refuse receipt of information, and economic and technology development zones will allow approvals with minor filing lapses.

Cyberspace Administration of China, Measures on Cybersecurity Reviews (Draft for Comments)

Where any of the following circumstances could be caused to arise when a critical information infrastructure operator procures network products or services, it shall file for a cybersecurity review with the cybersecurity review office:

(1)        the entirety of the critical information infrastructure ceases to operate or its major functions fail to operate normally;

(2)        a large quantity of personal information or important data leaks, is lost, is damaged or transferred overseas; or

(3)        operational maintenance of, technical support for, or updating or upgrading of, the critical information infrastructure faces a security threat to the supply chain.

Cyberspace Administration of China, Measures for the Administration of Data Security (Draft for Comments)

Where a network operator utilizes user data and algorithms to push news information, commercial advertisements, etc., it shall clearly label the same with the words "directional pushing" and provide users a function to stop the receipt of directionally pushed information; when a user opts to stop receiving directionally pushed information, the pushing thereof shall be halted and user data and personal information such as the collected device identifier shall be deleted.
