Main contents: A financial institution may not provide roundabout services for the asset management product of another financial institution for the purpose of circumventing regulatory requirements in respect of the scope of investment, leverage constraints, etc.
An asset management product may invest in a single-layer asset management product, but the investment management product invested in may not invest in another asset management product (with the exception of public securities investment funds) (Article 21).
An asset management product shall set a ceiling on its liability percentage (gross assets/net assets), and the same ceiling shall apply to all identical products. The gross assets of each open-ended publicly offered product may not exceed 140% of the net assets of the product in question, and the gross assets of each closed-end publicly offered product and each privately offered product may not exceed 200% of the net assets of the product in question. When calculating the gross assets of any one product, the gross assets of the asset management products invested in shall also be counted in such calculation in accordance with the penetration principle.
The holder of an asset management product may not seek financing and increase leverage by pledging the units of the asset management product held by it (Article 19).
