Legislation roundup: R&D tax breaks, project consulting, and government pricing

The SAT has clarified the scope of R&D tax super-deductibles, and the NDRC has required record filing for project consulting firms and cost reviews for natural monopolies

State Administration of Taxation, Announcement on Issues Relevant to the Scope of Research and Development Expense Items for the Purpose of Pre-tax Super-deduction

R&D labor expenses that can be super-deducted include the wages/salaries, basic old-age insurance premiums, basic medical insurance premiums, unemployment insurance premiums, work-related injury insurance premiums, maternal insurance premiums and housing reserve contributions of personnel directly engaged in research and development activities as well as the service charges of outsourced research and development personnel.

Project consulting entities shall be subject to administration by means of notification-type record filing.

Credit rating of an industry self-regulatory nature shall serve only as reference when being engaged for a consulting matter. No entity may set practice limits on project consulting entities that have not participated or obtained a credit rating.
