Main contents: Social organizations and individuals may establish private for-profit institutions of higher learning and other institutions of higher education, senior high level educational institutions and kindergartens, but may not establish private for-profit schools that provide compulsory education (Article 2).
A private for-profit school may not solicit students during its preparatory phase (Article 5).
A social organization wishing to establish a for-profit private school shall satisfy the following conditions:
(1) having the status of a legal person of the People's Republic of China;
(2) having a good integrity rating, not appearing on the list of enterprises whose operations are characterized by irregularities or the list of seriously delinquent and discredited enterprises and not having a record of improper acts; and
(3) its legal representative having Chinese nationality, being permanently resident in China, having a good integrity rating and no criminal record, having political rights and full capacity for civil acts (Article 9).
An individual wishing to establish a for-profit private school shall, among others, have Chinese nationality and be permanently resident in China (Article 10).
Matters relating to for-profit private training institutions shall be handled with reference to these Rules (Article 49).
