Producers' environmental liability extended.

Applicability: The term “extended producer liability system” means the system whereby the resource and environmental liability borne by a producer in respect of its products is extended from the production stage to the entire life of the product, including design, distribution, consumption, recovery and reuse, and waste disposal (Preamble).

Main contents: The extended producer liability system will first be applied to four types of products: electrical appliances and electronic products, automobiles, lead-acid batteries and paper-based composite packaging for beverages (Section Three).

A producer shall comprehensively consider the impact on resources and the environment at each stage such as selection of raw and supplemental materials, production, packaging, sale, use, recovery and disposal in carrying out the ecological design of its products. Specifically, this includes minimization, uniformity, modularization, harm elimination (reduction), easy maintenance design as well as design for extended life, green packaging, energy saving, reduced consumption, recycling, etc.

Provided that the quality, functioning and safety of the product are maintained, producers are encouraged to increase the percentage of the use of recycled raw materials.

The liability for the recovery of discarded products and packaging may be realized through contributions to relevant funds by producers in accordance with the law or provision of subsidies to specialized enterprises.

Information such as product quality, safety, durability, energy efficiency, toxic and hazardous substance content will be made subject to mandatory disclosure (Section Four).
