Legislation roundup: FDI approvals, mobile apps and private schools

The NDRC has relaxed foreign-invested project approvals, the MIIT has tightened controls for apps on smart devices and for-profit private schools have been subject to separate administration

National Development and Reform Commission, Circular on Duly Carrying Out the Foreign Investment Related Tasks Relevant to the Thorough Implementation of the <List of Investment Projects Subject to Government Check and Approval (2016)>

The Circular raises the threshold requirement for NDRC check and approval from US$100 million to US$300 million of total investment amount (including capital increase) of the projects in the restricted category of the Foreign Investment Industrial Guidance Catalogue.

Foreign-invested projects falling outside the scope of those subject to check and approval, and not included in the prohibited category of the Foreign Investment Industrial Guidance Catalogue shall be subject to record filing by the local development and reform department.

Producers and Internet information service providers shall ensure that application software of mobile smart terminals, other than software that provides basic functions, can be uninstalled.

Internet information service providers that engage in the provision of mobile app distribution platform services, such as app stores, and producers that pre-install mobile app distribution platforms on mobile smart terminals shall register information such as the true identity and contact information of the application software provider, operator and developer.
