Legislation roundup: Telecom Catalogue, High and New Technology Enterprises and R&D tax

The MIIT's 2015 Classified Catalogue of Telecommunications Services has expanded internet categories, HNTEs' IP requirements have been lowered and the SAT has permitted tax super-deductions for outsourcing R&D

Ministry of Industry and Information Technology, Classified Catalogue of Telecommunications Services (2015 Edition)

Based on the scope of the network that can be assembled by a service provider, the Catalogue divides internet data transmission services into three types, namely “Internet international data transmission services”, “Internet domestic data transmission services” and “Internet local data transmission services”.

Internet-related services such as IDC services, CDN services and internet resource collaboration services are listed as telecommunication services.

Ministry of Science and Technology, Ministry of Finance and State Administration of Taxation, Measures for the Administration of the Recognition of High and New Technology Enterprises (Revised)

For recognition of high and new technology enterprises, the revised Measures remove the criterion to have secured intellectual property during the most recent three years or possessed an exclusive licence for at least five years.

State Administration of Taxation, Announcement on Issues Relevant to the Policy of the Pre-tax Super-deduction of the Research and Development Expenses of Enterprises

The expenses that an enterprise incurs in commissioning a third party institution or individual to carry out research and development activities may be deducted before tax. The super-deduction base figure shall be 80% of the expenses incurred for the research and development activities.
