Main contents: The Draft adds 136 articles to the current Implementing Regulations, bringing the total to 200 articles.

The Draft requires a third party online food trading platform provider to file its business particulars such as its website and IP addresses with the local food and drug administration. A third party online food trading platform provider shall post in a prominent location on its website information on the food safety violations of online food producers and dealers (Article 60). The scope of business of an online food producer or dealer shall be consistent with the permitted scope of its physical dealings (Article 61). Procedures for spot checks on online food are also laid down (Article 96). The Draft expressly sets out the specific circumstances of what constitutes “serious circumstances” of a food safety violation (Articles 168, 171, 173, 175 and 183).
