CATALOGUE OF INDUSTRIES IN WHICH FOREIGN INVESTMENT IS ENCOURAGED

1. Agriculture, Forestry, Animal Husbandry and Fisheries

(1) Cultivation, development and production with respect to edible oils, flavourings and industrial raw materials that are from woody plants.

(2) Development of cultivation technologies for green and organic vegetables (including edible fungi, watermelons and musk melons), dried and fresh fruits, and tea, and production of products thereof.

(3) Development of new cultivation technologies for crops such as sugar crops, fruit trees and pasturage, and production of products thereof.

(4) Production of flowers and plants and the construction and operation of nursery centres.

(5) Planting of rubber, oil palm, sisal and coffee.

(6) Growing and breeding of traditional Chinese medicine materials.

(7) Mulching and comprehensive utilisation of crop straw and the development and production of organic fertiliser resources.

(8) Breeding of aquaculture brood stock (not including precious and fine varieties unique to China).

(9) Construction and operation of ecological environment protection projects such as the planting of trees and grasses to prevent and treat desertification and prevent water loss and soil erosion.

(35) Ancillary raw materials for synthetic materials: production of epoxypropane by oxidising propylene with hydrogen peroxide, naphthalene dicarboxylate (NDC) 1,4-cyclohexanedimethanol (CHDM), 50,000 tonnes/year and above of adiponitrile by butadiene method, and hexanediamine

(36) Raw materials for synthetic fibres: production of nylon 66 salt and 1,3-propanediol.

(37) Synthetic rubber: production of isoprene rubber, polyurethane rubber, acrylic ester rubber, chlorohydrine rubber and special rubbers, such as fluororubber and silicon rubber.

(38) Engineering plastics and plastic alloys: Production of products such as 60,000 tonnes per year or more of polycarbonate (PC) by a phosgene-free method, polyoxymethylene by homopolymerisation, polyphenylene sulfide, polyetheretherketone, polyimides, polysulfone, polyethersulfone, polyarylate (PAR), polyphenylene oxide and its modified materials, and liquid crystal polymers.

(39) Fine chemicals: production of new catalysts and new technologies therefor, processing technology for the commercialisation of dyes (pigments), electronic chemicals and paper making chemicals, leather chemicals (with the exception of N-N dimethyl formamide), oil field auxiliaries, surfactants, water treatment agents, adhesives, inorganic fibres and inorganic nanometre materials, as well as treatment and further processing of pigment integument.

(40) Production of environmentally friendly printing inks and aromatic oils.

(41) Production of natural, compound and mono-isolate flavours.

(42) Production of high performance coatings, high solid content and solvent-free coatings, water-based industrial coatings and ancillary water-based resins.

(43) Production of high performance fluororesin, fluorinated film materials, fluorine containing intermediates for medical use, environmentally friendly fluorine-containing refrigerants, cleansers and foaming agents.

(44) Production of fluorine resources recovered from phosphorus chemistry and aluminium smelting.

(46) Development and production of inorganic, organic and biological films for environmental protection purposes.

(47) Development and production of new fertilisers: concentrated potassium fertilisers, compound microbial inoculants, compound microbial fertilisers, straw and refuse decomposition agents, and microbial preparations with special functions.

(48) Development and production of effective, safe and environmentally friendly new agrochemicals, new formulations, special purpose intermediates and adjuvants as well as the development and application of relevant clean production processes (acetochlor by the methylene method, chlorpyrifos process by the aqueous phase method, process for recovering chloromethane from glyphosate, production of chiral and stereo agrochemicals by the oriented synthesis method and technology for synthesising diethyl thiophosphoryl chloride).

(XII) Chemical Fibre Manufacturing

(63) Production of high and new technology chemical fibres such as differential chemical fibres and aramid fibres, carbon fibres, high tensile high modulus polyethylene and polyphenylene sulfide (PPS) (excluding viscose fibre).

(64) Production of new polyesters of fibre-grade or for use other than for fibres: Polytrimethylene terephthalate (PTT), polyethylene naphthalate (PEN), polycyclohexylene dimethylene terephthalate (PCT) and modified polyethylene terephthalate glycol (PETG).

(65) Use of new recyclable resources and environmentally friendly processes to produce bio-fibres, including cellulose fibre by the new solvent method (Lyocell), recycled cellulose fibres from raw materials such as bamboo and hemp, polylactic acid fibres (PLA), chitin fibre, polyhydroxyalkanoate fibre (PHA), plant and animal protein fibres, etc.

(66) Development and production of new polyamides, such as nylon 11, nylon 1414, nylon 46, long carbon chain nylon and high temperature resistant nylon.

(67) Production of aramid fibres and cord for radial tyres.

(XIII) Rubber and Plastic Product Industry

(68) Development and production of new photo ecological multifunction wide-format agricultural films.

(69) Recycling of waste and old plastic material.

(70) Development of new technologies for plastic soft packaging, and development and production of new products thereof (high separation, multifunctional films and raw materials).

(XIV) Non-metallic Ore Product Industry

(71) Development and production of energy saving, environmentally friendly, waste reusing, light-weight, high-strength, high performance and multifunction construction materials.

(72) Production of chemical construction materials that use plastic instead of steel or wood and that offer high energy savings and are effective.

(73) Production of waterproof coiled materials for elastomer, plastomer modified asphalt (annual production of at least 10 million square metres), wide-format (at least 2 metres) ethylene prop-ylene diene monomer rubber waterproof coiled materials and ancillary materials, wide-format (at least 2 metres) polyvinyl chloride waterproof coiled materials and TPO waterproof coiled materials.

(74) Development and production of new technology functional glass: electromagnetic shielding glass, glass substrates for microelectronics, infrared transmitting lead-free glass, electronics-grade large-size quartz glass products (tubes, plates, crucibles, instruments and wares, etc.), superior optical performance multifunction windshield glass, extreme materials and their products for information technology (including quartz glass bushings from waveguide grade high precision optical fibre pre-formed rods, and ceramic substrates), and purification of high purity (≥ 99.998%) and ultra pure (≥99.999%) crystal raw materials.

(75) Production of conductive glass for thin film batteries, glass for solar collectors and conductive glass used in construction.

(76) Production of glass fibre products and special glass fibres: low dielectric glass fibre, quartz glass fibre, high silica glass fibre, high-strength flexible glass fibre, ceramic fibre, etc. and their products.

(77) Production of optical fibres and their products: image bundle and laser medicine optical fibre, super second generation and third generation microchannel plates, optical fibre faceplates, image inverters and glass light cones.

(78) Standardised fine manufacture of ceramic raw materials and production of high-grade decoration materials for ceramics.

(79) Production of environmentally friendly (non-chromated) refractory materials for use in kilns and furnaces such as cement, electronic glass, ceramics and micropore carbon bricks.

(80) Production of aluminium nitride (AIN) ceramic substrate and porous ceramics.

(81) Production of inorganic non-metal new materials and their products: composite materials, special types of ceramics, special types of sealing materials (including high-speed oil seal materials), special friction materials (including high-speed friction braking products), special types of gelling materials, special latex materials, sonar rubber products and nano materials.

(82) Production of organic-inorganic syntactic foam insulation materials.

(83) Production of hi-tech compound materials: continuous fibre reinforced thermoplastic compound materials and pre-impregnated materials, process auxiliary materials for the shaping of resin matrix composites capable of withstanding heat > 300°C, resin matrix composites (including sports articles, and light-weight and high-strength components for means of transportation), special function composites and their products (including deep water and submarine composite products and composite products for medical and rehabilitation purposes), carbon/carbon composite materials, high performance ceramic matrix composites and their products, metal matrix and glass matrix composite materials and their products, metal laminated composites and their products, ultra-high pressure composite rubber tubing capable of withstanding pressures 320MPa, and tyres for large passenger aircraft.

(84) Production of precision high-performance ceramic raw materials: superfine powdered silicon carbide (SiC) (purity > 99%, average particle diameter < 1µm), superfine powdered silicon nitride (Si3N4) (purity > 99%, average particle diameter 99.9%, average particle diameter < 0.5µm), low temperature powdered sintered zirconium dioxide (ZrO2) (sintering temperature 99%, average particle diameter < 1µm), powdered rutile TiO2 (purity > 98.5%), white carbon black (particle diameter 99%, particle diameter < 1µm).

(85) Development and production of high quality artificial crystals and crystal film products: high quality synthetic crystals (piezoelectric crystals and ultraviolet transmitting crystals), superhard crystals (cubic boron nitride crystals), high temperature resistant, high insulating synthetic insulating crystals (synthetic mica), new electro-optic crystals, high-power laser crystals and large scintillating crystals, diamond film tools, and super-thin artificial diamond saw blades no thicker than 0.3mm.

(86) Fine processing of non-metallic ores (super-fine pulverising, high purity, fine manufacture, modification) into downstream products.

(87) Production of ultrahigh power graphite electrodes.

(88) Production of pearlescent mica (with a particle diameter of 3-150µm).

(94) Production of silicon monocrystals with a diameter of at least 200mm and polished wafers.

(95) Production of hi-tech non-ferrous materials: compound semiconductor materials (gallium arsenide, gallium phosphide, indium phosphide, gallium nitride), high temperature superconducting materials, memory alloys (titanium nickel alloy, copper matrix and iron matrix memory alloys), ultra-thin (nanometre) calcium carbide and ultra-thin (nanometre) crystalline hard alloys, super hard composites, precious metal composites, combinations of light metal composites and dissimilar materials, aluminium foil for heat dissipaters, capacitance aluminium foil for medium and high voltage cathodes, special large aluminium alloy bars, aluminium alloy precision stamp work, overhead lead wires for electrified railways, ultra-thin copper strip, copper alloy materials for corrosion resistant heat exchangers, high performance copper nickel, copper iron alloy strip, beryllium copper strip, wire, tubing and bar processed materials, heat resistant anti-fading tungsten filament, magnesium alloy cast goods, lead free soldering flux, magnesium alloys and their application products, foamed aluminium, titanium alloy smelting and processing, nuclear grade zirconium sponge, further processed tungsten and molybdenum products.

(XVI) Metal Product Industry

(96) Research, development and manufacture of new lighter and environmentally friendly materials for aviation, aerospace, automobiles and motorcycles (special aluminium sheet, aluminium magnesium alloys, aluminium alloy frames for motorcycles, etc.).

(97) Research, development and manufacture of light-metal and semi-solid rapid prototyping materials.

(98) Manufacture and processing of metal packaging products (with a thickness of less than 0.3mm) used to package contents such as various types of grains, oils, foodstuffs, fruits, vegetables, beverages and articles of daily use (including the printing of the inner and outer walls of the products).

(99) Manufacture of nickel-saving stainless steel products.

(XVII) General Equipment Manufacturing

(100) Manufacture of high-end numerically controlled machine tools and key parts and components: 5-axis ganged numerically controlled machine tools, numerically controlled jig borer machining centres, numerically controlled jig grinders, 5-axis ganged numerically controlled systems and servo devices, high speed super hard cutting tools for precision numerically controlled machining.

(101) Manufacture of multi-station machines weighing at least 1,000 tonnes.

(102) Manufacture of equipment for the dismantling, crushing and post-processing and sorting of decommissioned motor vehicles.

(103) Manufacture of FTL flexible production lines.

(104) Manufacture of vertical multi-jointed industrial robots, welding robots and their welding devices and equipment.

(105) Manufacture of special processing machinery: sets of laser cutting and welding equipment, laser precision processing equipment, numerically controlled low-speed cross-threading electric-spark line cutting machines and sub-micron grade ultra-fine crushers.

(106) Manufacture of wheeled or tracked lifting machinery weighing of at least 400 tonnes.

(107) Design and manufacture of high pressure piston pumps and motors operating at a working pressure of ≥ 35MPa and low-speed high-torque motors operating at a working pressure of ≥ 35MPa.

(108) Manufacture of integral hydraulic selector valves operating at a working pressure of ≥ 25MPa and electrohydraulic proportional servo components.

(109) Design and manufacture of valve terminals, pneumatic electromagnetic valves (power of not more than 0.35W) and high frequency electropneumatic valves (200Hz and above).

(110) Design and manufacture of hydrostatic actuating devices.

(111) Development and manufacture of non-contact gas film seals (pressure of at least 10MPa), dry gas seals (including testing devices) (pressure of at least 10MPa).

(112) Development and manufacture of high polymer material (friction discs, modified phenolic pistons, non-metallic hydraulic master wheel cylinders, etc.) equipment for motor vehicles.

(113) Manufacture of third or above generation sedan hub bearings, bearings for high and medium end digitally controlled machine tools and machining centres, bearings for high-speed wire and steel sheet rolling mills, high-speed rail bearings, low noise bearing with a vibration value of less than Z4, P4 and P2 grade bearings of various types, bearings for wind turbines and aviation bearings.

(114) Manufacture of high-density, high-precision and complex-shaped powder metallurgy components as well as chains for motor vehicles, construction machinery, etc.

(115) Manufacture of gear transmissions for wind turbines and high-speed trains, variable pitch gear transmission systems for vessels and large and heavy load bearing gear boxes.

(116) Manufacture of high-heat resistant insulating materials (insulating grade F or H) and shaped insulators.

(117) Development and manufacture of accumulator bladders, and rubber and plastic hydraulic and pneumatic seals.

(118) Manufacture of high precision, high-strength (12.9 grade and above), special-shaped, combination type fasteners.

(119) Manufacture of miniature precision transmission couplers (clutches).

(120) Manufacture of large coupling shafts for rolling mills.

(121) Re-manufacture of machinery and equipment, such as machine tools, construction machinery and locomotive equipment, and re-manufacture of automotive parts and components.

(122) Manufacture of 10 megapixel and above digital cameras.

(123) Manufacture of office machinery: multipurpose integrated office equipment (photocopying, printing, facsimile and scanning), colour printing equipment, precision of 2,400 dpi and above high resolution colour print heads and photosensitive drums.

(124) Manufacture of motion picture machinery: 2K and 4K digital movie projectors, digital movie cameras, digital video production and editing equipment.

(XVIII) Specialised Equipment Manufacturing

(125) Manufacture of mining trackless extraction, loading and transport equipment; mechanical transmission dumpers for mine use with a capacity of 200 tonnes or more; movable crushers; bucket wheel excavators with a capacity of 5,000 m3/hour or more; loaders for mine use with a capacity of 8 m3 or more; 2,500 kW and above electric traction coal cutting equipment, etc.

(126) Manufacture of geophysical exploration (excluding gravity and magnetic surveying) and well-logging equipment: MEME seismic detectors; digital telemetering seismographs; digital imaging and numerically controlled well-logging systems; horizontal well, directional well and drilling devices and apparatus; and MWD logging while drilling instruments.

(127) Manufacture of oil exploration, drilling, collection and transport equipment: floating drilling systems and floating production systems for working depths of greater than 1,500 metres, and supporting sea-floor oil extraction, gathering and transportation equipment.

(128) Manufacture of large aperture (at least 2 metres) rotary drilling machines capable of depths of at least 30 metres, pipe pushers with a diameter of at least 1.2 metres, large sets of non-excavating underground pipe laying equipment with a pull-back force of at least 300 tonnes, and underground continuous wall borers.

(135) Design and manufacture of repair and maintenance machinery and inspection and monitoring equipment for large-scale railway construction, rail lines, bridges and tunnels, and key parts and components thereof.

(136) Manufacture of (asphalt) shingle equipment, production equipment for metal roofs, such as galvanised sheet roofs.

(137) Manufacture of on-site polyurethane spray waterproof thermal insulation system equipment that is environmentally friendly and energy saving, formulation technologies and equipment for polyurethane sealing compounds, formulation technologies and production equipment for modified silicone sealing compounds.

(138) Design and manufacture of high precision strip rolling mills (thickness accuracy of 10 microns).

(139) Manufacture of dressing apparatus for multi-element, fine particle refractory metal ores.

(140) Manufacture of key component equipment for sets of ethylene equipment with an annual capacity of at least 1 million tonnes per year: hybrid pelletisers with an annual processing capacity of 400,000 tonnes, screw discharge centrifuges with a diameter of at least 1000mm, low flow-rate high-lift centrifugal pumps.

(141) Design and manufacture of dies for metal products (copper, aluminium, titanium and zirconium tubing, bar and section compression dies).

(142) Design and manufacture of stamping dies for vehicle body covering components, large injection moulds for automotive instrument panels, bumpers, etc., clamps and testing tools for automobiles and motorcycles.

(143) Design and manufacture of special purpose production equipment for automotive power batteries.

(144) Design and manufacture of precision dies (stamping dies of a precision exceeding 0.02 mm, cavity dies of a precision exceeding 0.05 mm).

(145) Design and manufacture of dies for non-metal products.

(146) Manufacture of beer bottling equipment with a capacity of at least 60,000 bottles per hour, beverage medium temperature and hot bottling equipment with a capacity of at least 50,000 bottles per hour, sterile bottling equipment with a capacity of at least 36,000 bottles per hour.

(147) Manufacture of production technologies and key equipment for amino acids, enzymic preparations, food additives, etc.

(148) Manufacture of complete sets of feed processing equipment with a capacity of 10 tonnes/hour or more, and of key parts and components therefor.

(341) Construction and operation of comprehensive water conservancy hubs (the Chinese party shall hold a controlling interest).

(343) Construction and operation of rail transport such as urban underground railways and light railways.

(344) Construction and operation of sewage and garbage treatment plants, hazardous waste treatment and disposal plants (incinerators and landfills) and facilities for the prevention and control of environmental pollution.

(345) Non-scholastic vocational training institutions.

11. Health and Social Work

(346) Institutions providing services to the elderly, disabled and children.

(347) Elderly nursing homes.

12. Cultural, Sports and Leisure Business

(348) Operation of performance venues.

(349) Operation of sports stadiums, bodybuilding, sports competitions, sports training and intermediary services.

CATALOGUE OF INDUSTRIES IN WHICH FOREIGN INVESTMENT IS RESTRICTED

1. Agriculture, Forestry, Animal Husbandry and Fisheries

(1) Selective breeding of new varieties of agricultural crops and the production of seeds (the Chinese party shall hold a controlling interest).

2. Mining

(2) Prospecting and mining of special and scarce coals (the Chinese party shall hold a controlling interest).

(3) Prospecting and mining of precious metals (gold, silver, and platinum group).

(4) Prospecting and mining of graphite.

(5) Mining and dressing of lithium ores.

3. Manufacturing

(6) Processing of edible oils, such as soybean oil, rapeseed oil, peanut oil, cottonseed oil, camellia oil, sunflower oil and palm oil (the Chinese party shall hold a controlling interest), processing of rice, flour and raw sugar, further processing of corn.

(7) Production of liquid biofuels (fuel ethanol and biodiesel) (the Chinese party shall hold a controlling interest).

(8) Printing of publications (the Chinese party shall have a controlling interest).

(9) Smelting of rare metals, such as tungsten, molybdenum, tin (excluding tin compounds) and antimony (including antimony oxide and antimony sulphide).

(10) Smelting and separation of rare earths (limited to equity and cooperative joint ventures).

(11) Manufacture of assembled vehicles, special purpose vehicles and motorcycles: the shareholding percentage of the Chinese party shall not be less than 50%; one foreign investor may establish up to two equity joint ventures producing the same type of (passenger vehicle, commercial vehicle, motorcycle) assembled vehicles in China; if it acquires another domestic vehicle manufacturer jointly with its Chinese joint venture partner, it may be exempted from the limitation of two joint ventures.

(12) Repair, design and manufacture of vessels (including sections) (the Chinese party shall hold a controlling interest).

(13) Production of satellite television and radio ground receiving facilities and key components.

4. Electricity, Heat, Gas and Water Generation and Supply

(14) Construction and operation of coal fired condensing power stations with a unit capacity of up to 300mW, cogeneration plants with coal fired condenser extractor units with a unit capacity of up to 100mW within small grids.

(15) Construction and operation of gas, heat and water supply and drainage networks for cities with populations of at least 500,000 people (the Chinese party shall hold a controlling interest).

5. Communications, Transportation, Warehousing, and Postal Services

(16) Companies engaged in the transportation of passengers by rail (the Chinese party shall hold a controlling interest).

(17) Companies engaged in the transportation of passengers by road.

(18) Companies engaged in transportation by water (the Chinese party shall hold a controlling interest).

(19) Airline companies for executive flights, air tours, photography, prospecting, industry, etc. (the Chinese party shall hold a controlling interest).

6. Information Transmission, Software and Information Technology Service Industry

(20) Telecommunications companies: value-added telecommunications services (foreign investment not exceeding 50%, except for e-commerce) and basic telecommunications services (foreign investment not exceeding 49%).

7. Wholesale and Retail

(21) Grain purchase, grain and cotton wholesale, and construction and operation of large agricultural product wholesale markets.

(22) Vessel agency (the Chinese party shall hold a controlling interest), ocean shipping tallying (limited to equity and cooperative joint ventures).

(23) Construction and operation of petrol stations (if one foreign investor establishes more than 30 stations or chain petrol stations selling different types and brands of refined oil products from multiple suppliers, the Chinese party shall have a controlling interest).

8. Financial Industry

(24) Banks (where a single foreign financial institution and an affiliated party controlled by it or under joint control with it invests in a single Chinese-invested commercial bank as promoter or strategic investor, their equity interest therein may not exceed 20%; where multiple foreign financial institutions and affiliated parties controlled by them or under joint control with them invest in a single Chinese-invested commercial bank as promoters or strategic investors, their equity interest therein may not exceed 25% in total; a foreign financial institution that invests in a small or medium rural financial institution must be a banking financial institution).

(25) Insurance companies (the foreign investment percentage in a life insurance company may not exceed 50%).

(26) Securities companies (at the time of establishment, limited to engaging in the underwriting and sponsorship of renminbi denominated common shares, foreign investment shares, and government bonds and corporate bonds, brokering of foreign investment shares, and the brokering and dealing in for own account of government bonds and corporate bonds; qualified companies may apply to expand their scopes of business once two years have elapsed since establishment; foreign investment percentage may not exceed 49%) and securities investment fund management companies (foreign investment percentage may not exceed 49%).

(27) Futures companies (the Chinese party shall hold a controlling interest).

9. Leasing and Commercial Services Business

(28) Market surveys (limited to equity and cooperative joint ventures; radio and television listener and viewer surveying requires control by the Chinese party).

(29) Credit check and rating service companies.

10. Scientific Research and Technical Services

(30) Surveying and cartography companies (the Chinese party shall have a controlling interest).

11. Education

(31) Institutes of higher education (limited to cooperative joint ventures, and the Chinese party shall have a leading role*).

(32) Ordinary high school educational institutions (limited to cooperative joint ventures, and the Chinese party shall have a leading role).

(33) Pre-school educational institutions (limited to cooperative joint ventures, and the Chinese party shall have a leading role).

12. Health and Social Work

(34) Medical institutions (limited to equity and cooperative joint ventures).

13. Cultural, Sports and Leisure Business

(35) Radio or television programme and motion picture production (limited to cooperative joint ventures).

(36) Construction and operation of cinemas (the Chinese party shall hold a controlling interest).

(37) Construction and operation of large theme parks.

(38) Performance brokering organisations (the Chinese party shall hold a controlling interest).

14. Other Industries That are Restricted by State Laws or Regulations or by International Treaties Concluded or Acceded to by China.

CATALOGUE OF INDUSTRIES IN WHICH FOREIGN INVESTMENT IS PROHIBITED

1. Agriculture, Forestry, Animal Husbandry and Fisheries

(1) Research, development, culturing and cultivation of valuable fine varieties rare in and unique to China and production of related propagation materials (including high-quality genes from the crop and plant cultivation industry, the animal husbandry industry and the aquatic products industry).

(2) Selective breeding of transgenic varieties of agricultural crops, breeding stock, breeding fowl and aquatic fingerlings and seedlings, and production of transgenic seeds (seedlings) thereof.

(3) Aquatic animal and plant fishing and dredging in China's marine jurisdictional waters and inland waters.

2. Mining

(4) Prospecting and mining of tungsten, molybdenum, tin, antimony and fluorspar.

(5) Prospecting, mining and dressing of rare earths.

(6) Prospecting, mining and dressing of radioactive minerals.

3. Manufacturing

(I) Medicine Manufacturing

(7) Processing of Chinese traditional medicinal materials included in the Regulations for Administration of the Protection of Wild Medicinal Material Resources and the List of Chinese Rare and Endangered Protected Plants.

(8) Application of techniques for the processing of soft lozenges of Chinese traditional medicines, such as steaming, parching, frying and calcining and the production of secret formulations of proprietary Chinese traditional medicines.

(II) Petroleum Processing, Coking and Nuclear Fuel Processing Industry

(9) Smelting and processing of radioactive minerals, and production of nuclear fuel.

(III) Specialised Equipment Manufacturing

(10) Manufacture of weapons and ammunition.

(IV) Other Manufacturing

(11) Ivory carving.

(12) Processing of tiger bones.

(13) Production of xuan paper, and ink ingots.

4. Electricity, Heat, Gas and Water Generation and Supply

(14) Construction and operation of coal fired condensing power stations with a unit capacity of up to 300mW, cogeneration plants with coal fired condenser extractor units with a unit capacity of up to 200mW within large grids.

5. Communications, Transportation, Warehousing, and Postal Services

(15) Air traffic control.

(16) Postal service companies, and domestic express mail delivery.

6. Wholesale and Retail

(17) Wholesale and retail of tobacco, cigarettes, flue-cured tobacco leaves and other tobacco products.

7. Lease and Commercial Service Business

(18) Social surveys.

(19) China legal affairs consulting (excluding the provision of information on the effect of the China legal environment).

8. Scientific Research and Technical Service Business

(20) Development and application of human stem cell, gene diagnostic and treatment technologies.

(21) Geodetic surveying, marine surveying and cartography, aerial photography for cartographic purposes, administrative division boundary surveying and cartography, compiling of topographic maps, world administrative maps, national administrative maps, provincial level and below administrative maps, national instructional maps, local instructional maps and three-dimensional maps, compiling of electronic navigational charts, and surveying concerning regional geological mapping, mineral geology, geophysical, geochemical, hydrogeological, environmental geology, geological hazards, remote sensing geology, etc.

9. Management of Water Conservancy, Environmental and Public Facilities

(22) Establishment and operation of nature preserves and internationally important wetlands.

(23) Development of state protected wild fauna and flora resources native to China.

10. Education

(24) Mandatory education institutions, educational institutions in special fields such as military academies, police academies, political academies and party schools.

11. Cultural, Sports and Leisure Business

(25) News agencies.

(26) Publication of books, newspapers and periodicals.

(27) Publication and production of audio and video products and electronic publications.

(28) Radio stations, television stations, radio and television channels (frequencies), radio and television transmission coverage networks (transmission stations, relay stations, radio and television satellites, satellite uplink stations, satellite reception and relay stations, microwave stations, monitoring stations and cable radio and television transmission coverage networks) at all levels.

(29) Companies engaged in the production or operation of radio or television programmes.

(30) Film production companies, distribution companies and cinema chain companies.

(31) Operation of news websites, online publishing services, network audio and video programme services, venues providing internet access services and internet culture (except for music).

(32) Operation of auction enterprises auctioning cultural artifacts and antique stores.

(33) Construction of golf courses and villas.

11. Other Industries

(34) Projects that jeopardise the safety and efficient use of military facilities.

(35) Gaming industry (including horse racetracks that offer betting).

(36) Sex industry.

12. Other Industries That are Prohibited by State Laws and Regulations or by International Treaties Concluded or Acceded to by China.

Notes: If otherwise provided in the Mainland and Hong Kong Closer Economic Partnership Arrangement and its supplementary agreements, the Mainland and Macao Closer Economic Partnership Arrangement and its supplementary agreements, the Cross-straits Economic Cooperation Framework Agreement and its subsequent agreements or a free trade area agreement or investment agreement between China and relevant countries, such provisions shall apply.

* The phrase “the Chinese party shall have a leading role” means, here and hereafter, that the president or chief administrative officer shall be a Chinese citizen and constituent members appointed by the Chinese party to the executive board, board of directors or joint management committee of the Sino-foreign cooperative educational institution may not be less than one-half.
