Tentative Regulations for the Registration of Immovable Property
不动产登记暂行条例
China implements a unified national immovable property registration system.
(Promulgated by the State Council on November 24 2014 and effective as of March 1 2015.)

Part One: General Provisions
国务院令第656号
Article 1: These Regulations have been formulated pursuant to laws such as the PRC Property Law in order to consolidate the responsibilities for immovable property registration, regulate registration acts, make the application by the public for registration convenient and protect the lawful rights and interests of rights holders.
Article 2: For the purposes of these Regulations, the term “immovable property registration” means the act whereby the immovable property registry records in accordance with the law title to rights in immovable property and other statutory matters in the immovable property register.
第一章 总则
For the purposes of these Regulations, the term “immovable property” means land, territorial waters as well as attachments such as premises and trees.
Article 3: These Regulations shall govern the initial registration of immovable property, amendment of registration, transfer of registration, cancellation of registration, correction of registration, opposition to registration, preliminary announcement of registration, registration of placement under seal, etc.
Article 4: The state implements a unified immovable property registration system.
第一条 为整合不动产登记职责,规范登记行为,方便群众申请登记,保护权利人合法权益,根据《中华人民共和国物权法》等法律,制定本条例。
Immovable property registration shall comply with the principles of strict administration, stability and continuity, and creating convenience for the public.
第二条 本条例所称不动产登记,是指不动产登记机构依法将不动产权利归属和其他法定事项记载于不动产登记簿的行为。
The rights in immovable property enjoyed by holders of rights in immovable property in accordance with the law shall not be affected by a change in the registry or registration procedure.
本条例所称不动产,是指土地、海域以及房屋、林木等定着物。
Article 5: Registration shall be carried out in accordance herewith for the following immovable property rights;
第三条 不动产首次登记、变更登记、转移登记、注销登记、更正登记、异议登记、预告登记、查封登记等,适用本条例。
(1) ownership of collective land;
第四条 国家实行不动产统一登记制度。
(2) ownership of buildings and structures, such as premises;
不动产登记遵循严格管理、稳定连续、方便群众的原则。
(3) ownership of forests and trees;
不动产权利人已经依法享有的不动产权利,不因登记机构和登记程序的改变而受到影响。
(4) the contracted management right to land such as arable land, forest land and grassland;
第五条 下列不动产权利,依照本条例的规定办理登记:
(5) the right to use construction land;
(一)集体土地所有权;
(6) the right to use homestead land;
(二)房屋等建筑物、构筑物所有权;
(7) the right to use territorial waters;
(三)森林、林木所有权;
(8) easement;
(四)耕地、林地、草地等土地承包经营权;
(9) mortgage rights; and
(五)建设用地使用权;
(10) other immovable property rights that are required to be registered by law.
(六)宅基地使用权;
Article 6: The State Council department in charge of land and resources is in charge of guiding and monitoring immovable property registration nationwide.
(七)海域使用权;
A local people's government at the county level or above shall designate a department to be the immovable property registry for its administrative region, which shall be responsible for immovable property registration work and be subject to the guidance and monitoring of the competent immovable property registries of people's governments at higher levels.
(八)地役权;
Article 7: Immovable property registration shall be carried out by the immovable property registry of the county-level people's government of the place where the immovable property is located. The people's government of a municipality directly under the central government or city (divided into districts) may designate its own immovable property registry to centrally handle immovable property registration for all of the districts under its jurisdiction.
(九)抵押权;
Cross-county-level administrative region immovable property registration shall be handled separately by each of the immovable property registries of the different county-level administrative regions involved. Where the same cannot be handled by each separately, it shall be handled through consultations between/among the immovable property registries of the different county-level administrative regions involved. If the consultations are unsuccessful, registration shall be handled by the immovable property registry designated by the competent immovable property registry of the people's government at the next higher level common to them.
(十)法律规定需要登记的其他不动产权利。
Immovable property registration for forests, woods and forest land of key state-owned forest zones determined by the State Council, use of seas or islands for projects approved by the State Council, state-owned land used by central state authorities, etc. shall be provided for by the State Council department in charge of land and resources in concert with relevant departments.
第六条 国务院国土资源主管部门负责指导、监督全国不动产登记工作。
Part Two: Immovable Property Register
县级以上地方人民政府应当确定一个部门为本行政区域的不动产登记机构,负责不动产登记工作,并接受上级人民政府不动产登记主管部门的指导、监督。
Article 8: Registration of immovable property shall be carried out with the immovable property unit as the basic unit. Each immovable property unit has a unique number.
第七条 不动产登记由不动产所在地的县级人民政府不动产登记机构办理;直辖市、设区的市人民政府可以确定本级不动产登记机构统一办理所属各区的不动产登记。
An immovable property registry shall keep a unified immovable property register in accordance with the provisions of the State Council department in charge of land and resources.
跨县级行政区域的不动产登记,由所跨县级行政区域的不动产登记机构分别办理。不能分别办理的,由所跨县级行政区域的不动产登记机构协商办理;协商不成的,由共同的上一级人民政府不动产登记主管部门指定办理。
The immovable property register shall record the following particulars:
国务院确定的重点国有林区的森林、林木和林地,国务院批准项目用海、用岛,中央国家机关使用的国有土地等不动产登记,由国务院国土资源主管部门会同有关部门规定。
(1) natural particulars of the immovable property, such as its location, boundaries, spatial limitations, area and purpose;
(2) title particulars such as the entity with, and the type, details, source and term of, the immovable property rights and changes in the rights;
(3) matters involving restrictions on and warnings regarding the immovable property rights; and

(4) other relevant particulars.
Article 9: The electronic medium shall be used for the immovable property register. Where the conditions for keeping it in such format are as yet unsatisfied, the paper medium may be used. The immovable property registry shall specify the unique and lawful medium form for the immovable property register.
Where the electronic medium is used for the immovable property register, offsite backups shall be made on a regular basis, and there shall be a unique and definite manner for converting it to hard copy.
第八条 不动产以不动产单元为基本单位进行登记。不动产单元具有唯一编码。
Article 10: The immovable property registry shall accurately, completely and clearly record all of the registration particulars in the immovable property register in accordance with the law. No one may damage or destroy the immovable property register or revise the registered particulars, except for corrections made in accordance with the law.
不动产登记机构应当按照国务院国土资源主管部门的规定设立统一的不动产登记簿。
Article 11: Working personnel for immovable property registration shall have the professional knowledge and vocational skills appropriate for immovable property registration work.
不动产登记簿应当记载以下事项:
An immovable property registry shall strengthen the management of, and the professional technical training given to, its working personnel for immovable property registration.
(一)不动产的坐落、界址、空间界限、面积、用途等自然状况;
Article 12: An immovable property registry shall designate specific personnel to be responsible for the safekeeping of the immovable property register, and establish and improve the corresponding security responsibility system.
(二)不动产权利的主体、类型、内容、来源、期限、权利变化等权属状况;
Where the immovable property register is kept in hard copy format, the necessary safety precautions to prevent theft, fire, water damage, pests, etc. shall be put in place.
(三)涉及不动产权利限制、提示的事项;
Where the immovable property register is kept on the electronic medium, dedicated storage facilities shall be put in place and information network security measures shall be taken.
(四)其他相关事项。
Article 13: The immovable property register shall be kept by the immovable property registry in perpetuity. If the immovable property register is damaged, destroyed or lost, the immovable property registry shall recreate it based on the original registration materials.
第九条 不动产登记簿应当采用电子介质,暂不具备条件的,可以采用纸质介质。不动产登记机构应当明确不动产登记簿唯一、合法的介质形式。
If an administrative region changes or the functions of the immovable property registry are revised, the immovable property register shall be transferred to the appropriate immovable property registry in a timely manner.
不动产登记簿采用电子介质的,应当定期进行异地备份,并具有唯一、确定的纸质转化形式。
Part Three: Registration Procedure
第十条 不动产登记机构应当依法将各类登记事项准确、完整、清晰地记载于不动产登记簿。任何人不得损毁不动产登记簿,除依法予以更正外不得修改登记事项。
Article 14: Where an application for immovable property registration is made in connection with a transaction, creation of mortgage rights, etc., the parties shall file the application jointly.
第十一条 不动产登记工作人员应当具备与不动产登记工作相适应的专业知识和业务能力。
A party may apply unilaterally in any of the following circumstances:
不动产登记机构应当加强对不动产登记工作人员的管理和专业技术培训。
(1) an initial application for registration is made for immovable property that has never been registered;
第十二条 不动产登记机构应当指定专人负责不动产登记簿的保管,并建立健全相应的安全责任制度。
(2) immovable property rights are secured through succession or acceptance of a bequest;
采用纸质介质不动产登记簿的,应当配备必要的防盗、防火、防渍、防有害生物等安全保护设施。
(3) immovable property rights are established, modified, transferred or extinguished by virtue of a valid legal document from a people's court or arbitration commission or a valid decision from a people's government;
采用电子介质不动产登记簿的,应当配备专门的存储设施,并采取信息网络安全防护措施。
(4) an application for amendment of registration is made due to a change in the name of the rights holder or the natural particulars;
第十三条 不动产登记簿由不动产登记机构永久保存。不动产登记簿损毁、灭失的,不动产登记机构应当依据原有登记资料予以重建。
(5) an application for cancellation of registration is made due to destruction or loss of the immovable property or abandonment of the rights therein by the rights holder;
行政区域变更或者不动产登记机构职能调整的,应当及时将不动产登记簿移交相应的不动产登记机构。
(6) an application is made for correction of registration or opposition to registration; or
(7) another circumstance as specified in laws or administrative regulations under which a party may apply unilaterally applies.
Article 15: A party or his/her agent shall present himself/herself at the office of the immovable property registry to apply for immovable property registration.
第三章 登记程序
The applicant may withdraw his/her registration application before the immovable property registry records the registration particulars applied for in the immovable property register.
Article 16: An applicant shall submit the following application materials and be liable for their truthfulness:
(1) a written application for registration;
第十四条 因买卖、设定抵押权等申请不动产登记的,应当由当事人双方共同申请。
(2) the applicant's and agent's identity documents and power of attorney;
属于下列情形之一的,可以由当事人单方申请:
(3) documentation evidencing the provenance of title to the relevant immovable property, the document evidencing the reason for registration and the title certificate for the immovable property;
(一)尚未登记的不动产首次申请登记的;
(4) documentation on the boundaries, spatial limitations, area, etc. of the immovable property;
(二)继承、接受遗赠取得不动产权利的;
(5) documentation giving an account of the material interests of others; and
(三)人民法院、仲裁委员会生效的法律文书或者人民政府生效的决定等设立、变更、转让、消灭不动产权利的;
(6) other materials as specified in laws, administrative regulations and the detailed implementing rules herefor.
(四)权利人姓名、名称或者自然状况发生变化,申请变更登记的;
The immovable property registry shall display information such as a list of the materials required to apply for registration and sample texts in its offices and on its official website.
(五)不动产灭失或者权利人放弃不动产权利,申请注销登记的;
Article 17: When an immovable property registry receives application materials for immovable property registration, it shall proceed depending on the circumstances set forth below:
(六)申请更正登记或者异议登记的;
(1) if the application falls within the scope of its registration duties, and the application materials are in order and in the statutory format, or the applicant has provided all of the additional application materials as required or corrected all of the application materials as required, it shall accept the same and inform the applicant in writing;
(七)法律、行政法规规定可以由当事人单方申请的其他情形。
(2) if the application materials contain errors that can be corrected on the spot, it shall inform the applicant to make the corrections on the spot, and once the applicant has done so, it shall accept the application materials and inform the applicant in writing;
第十五条 当事人或者其代理人应当到不动产登记机构办公场所申请不动产登记。
(3) if the application materials are not in order or not in the statutory format, it shall inform the applicant on the spot in writing that it is not accepting the materials and inform him/her one time of all the additional materials that need to be provided and all the materials that need to be corrected; or
不动产登记机构将申请登记事项记载于不动产登记簿前,申请人可以撤回登记申请。
(4) if the immovable property for which the application for registration is made falls outside its scope of registration, it shall inform the applicant on the spot in writing that it is not accepting the materials and inform him/her to apply to the competent registration authority.
第十六条 申请人应当提交下列材料,并对申请材料的真实性负责:
If the immovable property registry fails to inform the applicant on the spot in writing that it is not accepting the application materials, it shall be deemed to have accepted the same.
(一)登记申请书;
Article 18: When an immovable property registry accepts an application for immovable property registration, it shall conduct its examination in accordance with the following requirements:
(二)申请人、代理人身份证明材料、授权委托书;
(1) whether the materials on the boundaries, spatial limitations, area, etc. of the immovable property are consistent with the characteristics of the immovable property for which the application for registration is made;
(三)相关的不动产权属来源证明材料、登记原因证明文件、不动产权属证书;
(2) whether the relevant supporting materials and documents are consistent with the particulars for which the application for registration is made; and
(四)不动产界址、空间界限、面积等材料;
(3) whether the application for registration violates laws or administrative regulations.
(五)与他人利害关系的说明材料;
Article 19: The immovable property registry may conduct an onsite inspection of the immovable property for which an application for registration is made if:
(六)法律、行政法规以及本条例实施细则规定的其他材料。
(1) ownership of a building or structure, such as premises, is being registered for the first time;
不动产登记机构应当在办公场所和门户网站公开申请登记所需材料目录和示范文本等信息。
(2) mortgage rights over a building under construction are being registered;
第十七条 不动产登记机构收到不动产登记申请材料,应当分别按照下列情况办理:
(3) a cancellation of registration is being carried out due to the loss or destruction of immovable property; or
(一)属于登记职责范围,申请材料齐全、符合法定形式,或者申请人按照要求提交全部补正申请材料的,应当受理并书面告知申请人;
(4) another circumstance under which the immovable property registry deems it necessary to conduct an onsite inspection applies.
(二)申请材料存在可以当场更正的错误的,应当告知申请人当场更正,申请人当场更正后,应当受理并书面告知申请人;
For an application for registration that could involve a title dispute or the material interests of another, the immovable property registry may conduct an investigation with the applicant, the materially interested party or relevant entities.
(三)申请材料不齐全或者不符合法定形式的,应当当场书面告知申请人不予受理并一次性告知需要补正的全部内容;
When an immovable property registry conducts an onsite inspection or investigation, the applicant and the parties being investigated shall offer their cooperation.
(四)申请登记的不动产不属于本机构登记范围的,应当当场书面告知申请人不予受理并告知申请人向有登记权的机构申请。
Article 20: An immovable property registry shall complete the immovable property registration procedures within 30 working days from the date of acceptance of the application for registration, unless otherwise provided in law.
不动产登记机构未当场书面告知申请人不予受理的,视为受理。
Article 21: Registration of the registered particulars shall be completed once they are recorded in the immovable property register.
第十八条 不动产登记机构受理不动产登记申请的,应当按照下列要求进行查验:
Once the immovable property registry completes the registration, it shall issue the applicant an immovable property title certificate or registration certificate in accordance with the law.
(一)不动产界址、空间界限、面积等材料与申请登记的不动产状况是否一致;
Article 22: The immovable property registry shall refuse registration and inform the applicant thereof in writing if:
(二)有关证明材料、文件与申请登记的内容是否一致;
(1) the application for registration violates a law or a set of administrative regulations;
(三)登记申请是否违反法律、行政法规规定。
(2) an unresolved title dispute exists;
第十九条 属于下列情形之一的,不动产登记机构可以对申请登记的不动产进行实地查看:
(3) the specified term for the rights in the immovable property for which registration is applied for has expired; or
(一)房屋等建筑物、构筑物所有权首次登记;
(4) another circumstance under which laws or administrative regulations render refusal of registration applies.
(二)在建建筑物抵押权登记;
Part Four: Sharing and Protection of Registration Information
(三)因不动产灭失导致的注销登记;
Article 23: The State Council department in charge of land and resources shall establish, in concert with relevant departments, a unified basic management platform for immovable property registration information.
(四)不动产登记机构认为需要实地查看的其他情形。
The information registered by immovable property registries at every level shall be incorporated into the unified basic management platform for immovable property registration information so as to ensure real-time sharing of registration information by the state, provincial, municipal and county levels.
对可能存在权属争议,或者可能涉及他人利害关系的登记申请,不动产登记机构可以向申请人、利害关系人或者有关单位进行调查。
Article 24: Information relating to immovable property registration as well as examination and approval information, transaction information, etc. of the housing and urban-rural development, agriculture, forestry, marine and other such departments shall be interoperable and shareable in real time.
不动产登记机构进行实地查看或者调查时,申请人、被调查人应当予以配合。
Where the immovable property registry is able to obtain the information through real-time interoperability and sharing, it may not require an immovable property registration applicant to provide the same again.
第二十条 不动产登记机构应当自受理登记申请之日起30个工作日内办结不动产登记手续,法律另有规定的除外。
Article 25: Land and resources, public security, civil affairs, finance, tax, industry and commerce, financial, audit, statistics and other such departments shall strengthen the interoperability and sharing of immovable property registration related information.
第二十一条 登记事项自记载于不动产登记簿时完成登记。
Article 26: Immovable property registries, entities that share in immovable property registration information and their working personnel shall maintain the confidentiality of immovable property registration information. Necessary security and confidentiality measures shall be taken in accordance with the law for immovable property registration information that involves state secrets.
不动产登记机构完成登记,应当依法向申请人核发不动产权属证书或者登记证明。
Article 27: Rights holders and materially interested parties may review and take copies of immovable property registration materials in accordance with the law, and immovable property registries shall provide the same.
第二十二条 登记申请有下列情形之一的,不动产登记机构应当不予登记,并书面告知申请人:
Relevant state authorities may review and take copies of immovable property registration materials relating to the investigation and handling of matters in accordance with laws and administrative regulations.
(一)违反法律、行政法规规定的;
Article 28: An entity or individual wishing to review immovable property registration materials shall explain the objective thereof to the immovable property registry and may not use the immovable property registration materials so obtained for other purposes. Immovable property registration materials so obtained may not be disclosed without the consent of the rights holder.
(二)存在尚未解决的权属争议的;
Part Five: Legal Liability
(三)申请登记的不动产权利超过规定期限的;
Article 29: If a registration error by an immovable property registry causes injury to another or if the provision by a party of fraudulent materials when applying for registration causes injury to another, liability for compensation shall be borne in accordance with the PRC Property Law.
(四)法律、行政法规规定不予登记的其他情形。
Article 30: If a member of the working personnel of an immovable property registry carries out a fraudulent registration, damages, destroys or forges the immovable property register, revises registered particulars without authorisation or otherwise abuses his/her authority or is in dereliction of his/her duties, he or she shall be disciplined in accordance with the law. If another was caused injury, he or she shall be liable for compensation in accordance with the law. If a criminal offence is constituted, his/her criminal liability shall be pursued in accordance with the law.
Article 31: If an immovable property title certificate or immovable property registration certificate is forged or altered, or a forged or altered immovable property title certificate or immovable property registration certificate is sold or used, it shall be confiscated by the immovable property registry or public security authority in accordance with the law. If there is illegal income, the same shall be confiscated. If another was caused injury, liability for compensation shall be borne in accordance with the law. If a violation of public security administration is constituted, public security administration penalties shall be imposed. If a criminal offence is constituted, criminal liability shall be pursued in accordance with the law.
Article 32: If an immovable property registry, entity that shares in immovable property registration information or a member of its working personnel or an entity or individual that reviews immovable property registration materials violates state provisions by disclosing immovable property registration materials or registration information, or utilises immovable property registration materials or registration information to carry out improper activities, causing injury to another, it/he/she shall be liable for compensation in accordance with the law. The relevant responsible persons shall be disciplined in accordance with the law. If the act by the relevant responsible persons constitutes a criminal offence, their criminal liability shall be pursued in accordance with the law.
第四章 登记信息共享与保护
Part Six: Supplementary Provisions
Article 33: The various types of immovable property title certificates issued and immovable property registers produced in accordance with the law before the implementation hereof shall continue to be valid.
During the transition period for unified immovable property registration, the registration of contracted rights to manage rural land shall be handled in accordance with relevant state provisions.
第二十三条 国务院国土资源主管部门应当会同有关部门建立统一的不动产登记信息管理基础平台。
Article 34: The implementing rules herefor shall be formulated by the State Council department in charge of land and resources in concert with relevant departments.
各级不动产登记机构登记的信息应当纳入统一的不动产登记信息管理基础平台,确保国家、省、市、县四级登记信息的实时共享。
Article 35: These Regulations shall be effective as of March 1, 2015. In the event of a discrepancy between these Regulations and provisions on immovable property registration of administrative regulations promulgated before the implementation hereof, these Regulations shall prevail.
