Process for assessment of occupational diseases simplified for workers.

Main contents: If a party objects to the occupational disease diagnostic conclusion rendered by the occupational disease diagnosis institution, he or she may apply to the health administrative department at the level of city (divided into districts) of the place where the occupational disease diagnosis institution is located for an expert assessment (Article 36).

If the party is dissatisfied with the occupational disease assessment conclusion rendered at the level of city (divided into districts), he or she may apply to the provincial-level health administrative department of the place where the original assessment organisation is located for a further expert assessment. The provincial-level occupational disease assessment conclusion shall be final.

An occupational disease diagnosis institution may not serve as an institution that handles occupational disease assessments (Article 37).

The experts participating in an occupational disease assessment shall be determined by a random drawing from the expert pool, based on specialty, by the party applying for assessment or the institution that handles occupational disease assessments appointed by the party (Article 41).

The expenses for the diagnosis and assessment of an occupational disease shall be borne by the employer (Article 61).
