Part One: General provisions
第一章 总则
Article 1: Objectives and basis
第一条(目的和依据)
These Measures have been formulated pursuant to laws and regulations such as the PRC Trademark Law (中华人民共和国商标法), while taking into account the realities in Shanghai, in order to regulate the recognition of famous trademarks in Shanghai Municipality, protect the lawful rights and interests of owners and users of famous trademarks and consumers in Shanghai Municipality, and promote economic development.
为了规范上海市著名商标认定工作,保护上海市著名商标所有人、使用人和消费者的合法权益,促进经济发展,根据《中华人民共和国商标法》等法律、法规的规定,结合本市实际,制定本办法。
Article 2: Definition
第二条(定义)
For the purposes of these Measures, the term “famous trademark in Shanghai Municipality” (Famous Trademark) means a trademark that is familiar to the relevant public, has a relatively good reputation in the Shanghai market and has been recognised pursuant to these Measures.
本办法所称的上海市著名商标(以下简称“著名商标”),是指相关公众知晓、在本市市场上享有较高声誉并依照本办法规定予以认定的商标。
Article 3: Administrative department
第三条(管理部门)
The municipal administration for industry and commerce is responsible for arranging for the implementation hereof.
市工商部门负责组织实施本办法。
The economic and information technology, commerce, tax, quality and technical supervision, intellectual property, statistics and other such departments shall cooperate in the implementation of these Measures within their respective purviews.
经济信息化、商务、税务、质量技监、知识产权、统计等部门根据各自职责,协同实施本办法。
Article 4: Review and adjudication board and its work organisations
第四条(评审委员会及其工作机构)
The Famous Trademark Review and Adjudication Board (FTRAB), the establishment of which was arranged by the municipal administration for industry and commerce, shall be responsible for the review and adjudication work associated with the recognition of Famous Trademarks.
市工商部门组织设立的著名商标评审委员会(以下简称“评审委员会”),负责著名商标认定的评审工作。
The members of the FTRAB shall be persons recommended by relevant departments and entities; more specifically, they shall include:
评审委员会的委员由有关部门、单位推荐的人员组成,具体包括:
(1) representatives of associations such as the committee for the protection of consumer rights and interests, relevant industry associations and the Shanghai Trademark Association;
(一)消费者权益保护委员会、有关行业协会、上海市商标协会等社会团体的代表;
(2) experts in fields such as economics, law and intellectual property; and
(二)经济、法律、知识产权等领域的专家;
(3) representatives of the administration for industry and commerce, statistics, quality and technical supervision and other such relevant departments.
(三)工商、统计、质量技监等有关部门的代表。
The day-to-day affairs of the FTRAB shall be handled by the work organisation designated by the municipal administration for industry and commerce (FTRAB Work Organisation).
评审委员会的日常事务,由市工商部门指定的工作机构(以下称“评审委员会工作机构”)承担。
The method for selecting the members, term and review and adjudication rules of the FTRAB shall be formulated by the municipal administration for industry and commerce and made known to the public.
评审委员会的委员产生方式、任期以及评审规则,由市工商部门制定,并向社会公布。
Article 5: Basic principles
第五条(基本原则)
The principle of discretionary application for recognition of Famous Trademarks is implemented.
著名商标的认定申请,实行自愿原则。
The recognition of Famous Trademarks shall comply with the principles of “transparency, fairness and impartiality”.
著名商标的认定,遵循“公开、公平、公正”的原则。
Shanghai encourages natural persons, and legal persons and other organisations to apply for the registration of trademarks in accordance with the law, enhance the notoriety of their trademarks and strive to create Famous Trademarks.
本市鼓励自然人、法人及其他组织依法申请商标注册,提高商标知名度,争创著名商标。
Article 6: Responsibilities of entities
第六条(主体责任)
Owners and users of Famous Trademarks shall carry on their production and other business activities in accordance with relevant laws, regulations, rules and standards; ensure that the quality of the goods on which Famous Trademarks are used is reliable and safe, and continuously improve the systems for trademark use and management; subject themselves to monitoring by the public; and bear their social responsibilities.
著名商标所有人和使用人应当依照有关法律、法规、规章和标准从事生产、经营活动,保证所使用著名商标的商品质量可靠、安全,并不断完善商标使用和管理制度,接受社会监督,承担社会责任。
Part Two: Recognition of famous trademarks
第二章 著名商标的认定
Article 7: Application conditions
第七条(申请条件)
A trademark registrant may apply for recognition of a Famous Trademark if the following conditions are satisfied:
符合下列条件的,商标注册人可以申请认定著名商标:
(1) the trademark registrant is a natural person whose registered permanent residence is in Shanghai or who has a Shanghai residence permit, or is a legal person or other organisation lawfully established in Shanghai;
(一)商标注册人是具有本市户籍或持有本市居住证的自然人,或是依法在本市设立的法人、其他组织;
(2) title to the trademark is undisputed, it has been registered in China for at least two years and has actually been used for at least three years, and it has a relatively high degree of notoriety among the relevant public;
(二)商标权属无争议,在中国境内注册满2年并实际使用满3年,在相关公众中具有较高知名度;
(3) the quality of the goods on which the trademark is used is reliable and safe, and has a good market reputation;
(三)使用该商标的商品质量可靠、安全,具有良好的市场信誉;
(4) the sales turnover, profit, taxes and other such major economic indicators of the goods on which the trademark is used have, for the most recent three years, ranked in a leading position among competitors in Shanghai;
(四)使用该商标的商品近3年销售额、利润、税金等主要经济指标在本市同行业中居领先地位;
(5) the trademark registrant and user(s) have established a product quality complaint and dispute resolution system and the same operates well;
(五)商标注册人和使用人已建立商品质量投诉和纠纷处理制度且运行良好;
(6) the trademark registrant has established a trademark use and management system and the same operates well; and
(六)商标注册人已建立商标使用和管理制度且运行良好;
(7) neither the trademark registrant nor user(s) has/have committed a serious violation of the law in the most recent three years.
(七)商标注册人和使用人近3年未发生严重违法行为。
If a trademark registrant applying for recognition of a Famous Trademark is non-profit-making in nature, Item (4) of the preceding paragraph shall not apply.
非营利性质的商标注册人申请认定著名商标,不适用前款第(四)项规定。
Article 8: Submission of application
第八条(提出申请)
The municipal administration for industry and commerce shall issue an announcement by the end of March each year, specifying matters such as the deadline for applying for Famous Trademarks during the year in question and locations where applications are accepted.
市工商部门应当在每年3月底前发布公告,明确当年著名商标申请的期限、申请受理点等事项。
When applying for recognition of a Famous Trademark, a trademark registrant shall submit to the district or county administration for industry and commerce of the place where it is located a written application for recognition and relevant materials evidencing satisfaction of the conditions set forth in Article 7 hereof.
商标注册人申请认定著名商标,应当向所在地的区、县工商部门提交认定申请书和证明符合本办法第七条规定条件的相关材料。
An applicant shall be liable for the truthfulness and lawfulness of the materials it submits.
申请人应当对所提交材料的真实性和合法性负责。
Article 9: Acceptance and review
第九条(受理审查)
As delegated by the municipal administration for industry and commerce, district and county administrations for industry and commerce are responsible for accepting applications for the recognition of Famous Trademarks.
区、县工商部门接受市工商部门的委托,承担著名商标认定申请的受理工作。
A district or county administration for industry and commerce shall conduct its review of whether the application materials are all in order and render its decision on whether to accept the same within 30 days from the date of receipt thereof. If it decides to accept the application, it shall notify the applicant in writing and, within 10 days from the date of rendering the acceptance decision, deliver the application materials to the FTRAB Work Organisation. If it decides not to accept the application, it shall notify the applicant in writing and give its reasons.
区、县工商部门应当自收到申请材料之日起30日内,对申请材料是否齐全进行审查,并作出是否予以受理的决定。决定予以受理的,应当书面通知申请人,并自作出受理决定之日起10日内,将申请材料送交评审委员会工作机构;决定不予受理的,应当书面通知申请人并说明理由。
If missing application materials need to be provided, the district or county administration for industry and commerce shall inform the applicant one time to provide the same within the specified period of time. If the applicant fails to do so, it shall be deemed as having abandoned its application.
申请材料需要补正的,区、县工商部门应当一次性告知申请人限期补正。申请人逾期不补正的,视为放弃申请。
Article 10: Verification
第十条(核实情况)
The FTRAB Work Organisation shall conduct its investigation and verification as to whether the application for recognition satisfies the conditions set forth in Article 7 hereof and submit its written report to the FTRAB within three months after receipt of the materials delivered by the district or county administration for industry and commerce.
评审委员会工作机构应当在收到区、县工商部门递交的材料后3个月内,对认定申请是否符合本办法第七条规定的条件进行调查核实,并向评审委员会提交书面报告。
When conducting its investigation and verification, the FTRAB shall seek the opinions of relevant departments, industry associations, the committee for the protection of consumer rights and interests, and consumers' representatives.
评审委员会工作机构调查核实情况时,应当征求有关部门、行业协会、消费者权益保护委员会及消费者代表的意见。
Article 11: Centralised review and adjudication
第十一条(集中评审)
The FTRAB shall hold a meeting, conduct a centralised assessment of the recognition application materials and the written report of the FTRAB Work Organisation, and vote thereon.
评审委员会应当召开会议,对认定申请材料和评审委员会工作机构的书面报告集中进行评议和表决。
The number of members present at a review and adjudication meeting shall account for at least two-thirds of all the members of the FTRAB and the vote on the review and adjudication result of the FTRAB shall be conducted by secret ballot. A trademark will be recognised as a Famous Trademark only if at least two-thirds of all the members present at the review and adjudication meeting approve the application for recognition.
出席评审会议的委员人数应当占评审委员会委员总人数三分之二以上,并以无记名投票方式,表决产生评审委员会的评审结果。认定申请经占出席评审会议的委员总人数三分之二以上同意,方可认定为著名商标。
Article 12: Written undertaking and recusation
第十二条(书面承诺和回避)
A member of the FTRAB shall sign an undertaking, strictly abide by work codes such as the review and adjudication rules, and maintain the confidentiality of applicants' trade secrets; he/she may not disclose information on review and adjudication procedures.
评审委员会委员应当签署承诺书,严格遵守评审规则等工作规范,保守申请人的商业秘密,不得泄露评审的过程信息。
If a member present at a review and adjudication meeting has a material interest in the applicant that could affect the impartiality of the review and adjudication, he or she shall apply to recuse himself or herself. The recusation of a member of the FTRAB shall be decided by the chairman of the FTRAB. The recusation of the chairman of the FTRAB shall be collectively discussed and decided by the FTRAB.
出席评审会议的委员与申请人有利害关系,可能影响评审公正性的,应当申请回避。评审委员会委员的回避,由评审委员会主任决定;评审委员会主任的回避,由评审委员会集体讨论决定。
Article 13: Publication of review and adjudication results
第十三条(评审结果的公示)
The FTRAB shall issue a public notice of the Famous Trademark it intends to recognise based on the review and adjudication results.
评审委员会应当依据评审结果,发布拟认定著名商标的公示。
Any entity or individual may raise an objection in writing to the FTRAB Work Organisation and provide relevant supporting documentation within 15 days from the date of issue of the public notice of the Famous Trademark that the FTRAB intends to recognise.
自拟认定著名商标的公示发布之日起15日内,任何单位和个人可以以书面形式向评审委员会工作机构提出异议,并应当提供有关证明材料。
The FTRAB Work Organisation shall conduct its investigation and verification and submit its written report to the FTRAB within 30 days after receipt of the objection and supporting documentation.
评审委员会工作机构接到异议及证明材料后,应当在30日内调查核实,并向评审委员会提交书面报告。
Article 14: Recognition announcement and recognition certificate
第十四条(认定公告和认定证书)
If there are no objections by the expiration of the public notice period, or if there is an objection but the FTRAB determines that such objection is untenable, the municipal administration for industry and commerce shall recognise the Famous Trademark based on the review and adjudication result, and issue a recognition announcement and a recognition certificate.
公示期满无异议,或虽有异议但经评审委员会认定异议不成立的,由市工商部门依据评审结果,认定著名商标,并发布认定公告、颁发认定证书。
A Famous Trademark recognition certificate shall record such particulars as the name of the trademark registrant, the recognised trademark, the goods on which the trademark is used, the term of validity, etc.
著名商标认定证书应当载明商标注册人名称、经认定的商标以及使用该商标的商品、有效期等事项。
Article 15: Term of validity
第十五条(有效期)
A recognised Famous Trademark shall be valid for three years counting from the date of issuance of the recognition announcement.
经认定的著名商标有效期为3年,自认定公告发布之日起计算。
Article 16: Renewal and transfer
第十六条(延续和转让)
The owner of a Famous Trademark may submit a renewal application to the district or county administration for industry and commerce of the place where it is located within six months before the expiration of the term of validity of the Famous Trademark.
著名商标有效期届满前6个月内,著名商标所有人可以向所在地的区、县工商部门提出延续申请。
If the owner of a Famous Trademark transfers its registered trademark during the term of validity of the recognition, the transferee shall apply anew for its recognition as a Famous Trademark.
著名商标所有人在认定有效期内转让其注册商标的,受让人应当重新申请认定著名商标。
Articles 7 to 15 of this Part shall govern the conditions, procedure, term of validity, etc. of and for applications for the renewal of Famous Trademarks and new applications for the recognition of Famous Trademarks.
申请延续著名商标、重新申请认定著名商标的条件、程序、有效期等,适用本章第七条至第十五条规定。
Article 17: Fund assurance and use
第十七条(经费保障和使用)
The work funds for the recognition of Famous Trademarks shall be included in the budget by the municipal administration for industry and commerce and no fees will be charged to concerned parties.
认定著名商标的工作经费,由市工商部门列入预算,不向当事人收取任何费用。
No administrative authority at any level in Shanghai may use fiscal funds or other public resources to carry out commercial publicity for owners and users of Famous Trademarks.
本市各级行政机关不得利用财政资金或者其他公共资源为著名商标所有人和使用人进行商业宣传。
Part Three: Protection and administration of famous trademarks
第三章 著名商标的保护和管理
Article 18: Code for the use of famous trademarks
第十八条(著名商标的使用规范)
Owners and users of Famous Trademarks may use the words and mark “Shanghai Famous Trademark” on the packaging, trade dress, advertising and other such media of and for the recognised goods (Famous Trademark Goods). No other entity or individual may use the words and mark “Shanghai Famous Trademark” without authorisation.
著名商标所有人和使用人可以在经认定的商品(以下称“著名商标商品”)包装、装潢和广告等载体上使用“上海市著名商标”的字样和标识;其他任何单位和个人不得擅自使用“上海市著名商标”的字样和标识。
Article 19: Record filing of changes in registered particulars
第十九条(变更注册事项的备案)
If a change is legally made by a Famous Trademark owner to the registered particulars of a trademark, such change shall be reported to the municipal administration for industry and commerce for the record within 30 days from the date on which the change was approved by the Trademark Office of the State Administration for Industry and Commerce.
著名商标所有人依法变更商标注册事项的,应当自国家工商总局商标局核准变更之日起30日内,报市工商部门备案。
Article 20: List of protected famous trademarks
第二十条(著名商标保护名录)
The municipal administration for industry and commerce shall prepare and publish a list of protected Shanghai Famous Trademarks and send copies thereof to relevant departments in Shanghai and administrations for industry and commerce of other provinces and municipalities.
市工商部门应当编制发布上海市著名商标保护名录,并将名录抄告本市相关部门和外省市工商部门。
The municipal, district and county administrations for industry and commerce shall strengthen their active investigation and handling of infringements of the exclusive right to use registered trademarks that are Famous Trademarks.
市和区、县工商部门应当加强对侵犯著名商标注册商标专用权行为的主动查处。
Article 21: Protection of the descriptions, packaging and trade dress of goods
第二十一条(商品名称、包装、装潢的保护)
Where the proprietary description, packaging and/or trade dress of a Famous Trademark Good is used without authorisation or a description, packaging and/or trade dress similar to that of a Famous Trademark Good is used, causing confusion with the good in question and causing buyers to mistakenly believe that the same is the good in question, the administration for industry and commerce shall handle the matter in accordance with such laws and regulations as the PRC Anti-unfair Competition Law(中华人民共和国反不正当竞争法).
擅自使用著名商标商品特有的名称、包装、装潢,或使用与著名商标商品近似的名称、包装、装潢,造成与该商品相混淆,使购买者误认为是该商品的,由工商部门依据《中华人民共和国反不正当竞争法》等法律、法规予以处理。
Article 22: Restrictions on the registration of others' enterprise names
第二十二条(对他人企业名称登记的限制)
If an application is made to register words that are identical or similar to a Famous Trademark as an enterprise name and the applicant is in the same industry, the administration for industry and commerce shall withhold approval; if the applicant is in a different industry, but registration would be sufficient to cause confusion among the public and could cause harm to the lawful rights and interests of the Famous Trademark owner, the administration for industry and commerce shall withhold its approval.
以与著名商标相同或近似的文字申请企业名称登记,属同行业的,工商部门不予核准;属不同行业,但足以引起公众误认,并可能对著名商标所有人的合法权益造成损害的,工商部门不予核准。
Article 23: Coordination with other regions
第二十三条(异地协调)
If the exclusive right of a Famous Trademark owner to use its registered trademark that is a Famous Trademark is infringed outside the administrative area of Shanghai and it seeks the assistance of the municipal administration for industry and commerce, the municipal administration for industry and commerce shall liaise and coordinate with the administration for industry and commerce of the relevant province or municipality in a timely manner and provide guidance to the concerned party on how to safeguard its lawful rights and interests in the Famous Trademark.
著名商标所有人因其著名商标的注册商标专用权在本市行政区域外受到侵害,向本市工商部门请求帮助的,本市工商部门应当及时与外省市工商部门进行沟通、协调,并为当事人维护著名商标的合法权益提供指导。
Article 24: Administrative oversight
第二十四条(行政监管)
The municipal, district and county administrations for industry and commerce shall strengthen administration of Famous Trademarks, open and enhance files for the administration of Famous Trademarks, monitor and inspect the use of Famous Trademarks and guide the protection of Famous Trademarks.
市和区、县工商部门应当加强对著名商标的管理,建立、健全著名商标的管理档案,监督检查著名商标的使用情况,对著名商标的保护工作予以指导。
If another department discovers a violation of the law or regulations by an owner or user of a Famous Trademark, it shall report the same to the municipal administration for industry and commerce in a timely manner.
其他部门发现著名商标所有人和使用人存在违法违规情况的,应当及时通报市工商部门。
Article 25: Monitoring by the public
第二十五条(社会监督)
If any entity or individual discovers a violation of the law or regulations by the owner or a user of a Famous Trademark, it/he/she may lodge a complaint or make a report to the administration for industry and commerce and relevant departments.
任何单位和个人发现著名商标所有人、使用人存在违法违规情况,可以向工商部门和相关部门投诉、举报。
If the committee for the protection of consumer rights and interests discovers, in the course of the lawful performance of its duties, that the owner or a user of a Famous Trademark has committed an act that harms the lawful rights and interests of consumers, it shall inform the municipal administration for industry and commerce in writing.
消费者权益保护委员会在依法履行职责过程中,发现著名商标所有人或使用人有损害消费者合法权益行为的,应当书面告知市工商部门。
Article 26: Tracking of the quality of famous trademark goods
第二十六条(著名商标商品质量跟踪)
The municipal administration for industry and commerce shall regularly collect information on the quality of Famous Trademark Goods from relevant departments and the committee for the protection of consumer rights and interests and conduct selective tracking investigations of the quality of Famous Trademark Goods. If it finds a problem, it shall procure prompt rectification thereof by the owner and user(s) of the Famous Trademark.
市工商部门应当定期收集相关部门、消费者权益保护委员会有关著名商标商品质量的信息,有重点地开展著名商标商品质量跟踪调查;发现问题的,应当督促著名商标所有人和使用人及时整改。
Part Four: Legal liability
第四章 法律责任
Article 27: Cancellation of famous trademarks
第二十七条(著名商标的撤销)
If any of the following circumstances applies to an owner or user of a Famous Trademark, the municipal administration for industry and commerce shall, after a finding to that effect by the FTRAB, cancel the Famous Trademark and announce the same:
著名商标所有人、使用人有下列情形之一的,经评审委员会审定,由市工商部门撤销该著名商标,并予以公告:
(1) there are numerous complaints by consumers and they are not duly dealt with;
(一)消费者投诉集中,未妥善处理的;
(2) it has used the words or mark “Shanghai Famous Trademark” in a manner that runs counter to regulations, or has altered or lent its certificate of recognition or other such supporting document;
(二)违规使用“上海市著名商标”的字样、标识,或涂改、出借认定证书等证明文件的;
(3) it submitted fraudulent materials or used other fraudulent means to illegally secure recognition of its Famous Trademark;
(三)提交虚假材料或以其他欺诈手段骗取著名商标认定的;
(4) an adverse social impact has been caused by a problem in the quality of its Famous Trademark Goods; or
(四)因著名商标商品质量问题造成不良社会影响的;
(5) it has committed a serious violation of the law, such as carrying out fraudulent publicity, defrauding consumers, etc.
(五)发生虚假宣传、欺诈消费者等严重违法行为的。
If a Famous Trademark is cancelled due to a reason set forth in Item (1) or (2) of the preceding paragraph, no application may be made again for recognition of the Famous Trademark for five years; if a Famous Trademark is cancelled due to a reason set forth in Item (3), (4) or (5) of the preceding paragraph, no application may ever be made again for recognition of the Famous Trademark.
著名商标因前款第(一)、(二)项原因被撤销的,5年内不得重新申请认定著名商标;因前款第(三)、(四)、(五)项原因被撤销的,不得重新申请认定著名商标。
If there is a major disagreement as to whether a Famous Trademark should be cancelled, the FTRAB may decide to set a period of observation, with the FTRAB Work Organisation conducting follow-up investigations and submitting the investigation findings to the FTRAB for review and a decision.
评审委员会对是否撤销著名商标存在重大争议的,可以决定设立观察期,由评审委员会工作机构进行跟踪调查,并将调查结果提交评审委员会审定。
Article 28: Punishment of violations of the law
第二十八条(违法行为的处罚)
If, after a change in the registered particulars of a trademark, the owner of a Famous Trademark fails to apply for record filing thereof, the administration for industry and commerce shall order it to rectify the matter within a specified period of time. If it fails to do so, it shall be fined not less than Rmb1,000 and not more than Rmb5,000.
著名商标所有人的商标注册事项变更后未申请备案的,由工商部门责令限期改正;逾期不改正的,处以1000元以上5000元以下罚款。
If a party uses the words or mark “Shanghai Famous Trademark” without authorisation, the administration for industry and commerce shall order it to rectify the matter and may fine it not less than Rmb5,000 and not more than Rmb10,000; and if the circumstances are serious, the administration shall fine it not less than Rmb10,000 and not more than Rmb30,000.
擅自使用“上海市著名商标”字样、标识的,由工商部门责令改正,可并处5000元以上1万元以下罚款;情节严重的,处以1万元以上3万元以下罚款。
Article 29: Liability of members of the FTRAB for violations of the law
第二十九条(评审委员会委员的违规责任)
The municipal administration for industry and commerce shall revoke the qualifications of a member of the FTRAB and announce the same if:
评审委员会委员有下列情形之一的,由市工商部门撤销其委员资格,并予以公告:
(1) he or she takes advantage of his or her participation in review and adjudication work to seek illegitimate benefits;
(一)利用参与评审工作,谋取不正当利益的;
(2) he or she violates the work code on recusation or confidentiality, etc. resulting in an adverse effect; or
(二)违反回避、保密等工作规范,造成不良影响的;
(3) he or she refuses to participate in review and adjudication work without just cause.
(三)无正当理由,拒不参加评审活动的。
Article 30: Administrative liability
第三十条(行政责任)
If any of the following circumstances applies to an administration for industry and commerce or a member of its working personnel, the higher level authority or the inspection authority shall order it, him or her to rectify the matter and shall discipline the supervisor directly in charge and other responsible persons in accordance with the law; and if a criminal offence is constituted, criminal liability shall be pursued in accordance with the law:
工商部门及其工作人员有下列情形之一的,由其上级机关或监察机关责令改正,并依法对直接负责的主管人员和其他直接责任人员给予处分;构成犯罪的,依法追究刑事责任:
(1) it, he or she refused to accept an application for recognition of a Famous Trademark without just cause;
(一)无正当理由,拒不受理著名商标认定申请的;
(2) it, he or she recognised a Famous Trademark in a manner that violates the specified procedure;
(二)违反规定程序,认定著名商标的;
(3) it, he or she failed to perform its, his or her duties of protecting and administering Famous Trademarks in accordance with the law; or
(三)未依法履行著名商标保护和管理职责的;
(4) it, he or she committed another act of dereliction of duty, abuse of authority or practising favouritism by committing fraud.
(四)有其他玩忽职守、滥用职权、徇私舞弊行为的。

第五章 附则
Article 31: Service marks
第三十一条(服务商标)
The provisions of these Measures on marks on goods shall similarly apply to service marks.
本办法中有关商品商标的规定,同样适用于服务商标。
Article 32: Implementation date
第三十二条(施行日期)
These Measures shall be effective as of May 1 2012. Famous Trademarks recognised before the implementation hereof shall continue be valid for their existing terms of recognition.
本办法自2012年5月1日起施行。本办法施行前认定的著名商标,在原认定期限内继续有效。
