Guangdong Province, Operational Guidelines for the Transformation at the Original Location without Suspension of Production of Enterprises that Process Imported Materials

Applicability: The phrase “transformation of factories that process imported materials at the original location” refers to the continual operation of processing trade activities of enterprises or factories without independent legal personality that solely engage in the business of processing with imported materials subsequent to its transformation into a foreign-invested enterprise with independent legal personality (or enterprise of another type) at the original processing location. The term “after transformation” means that an enterprise has concluded a processing trade contract with a third party in the name of the newly-established foreign-invested enterprise (or enterprise of another type) and has obtained the approval of the competent foreign economic and trade department (Article 1).
