CATALOGUE OF INDUSTRIES IN WHICH FOREIGN INVESTMENT IS ENCOURAGED

1. Agriculture, Forestry, Animal Husbandry and Fisheries

(1) Improvement of medium- and low-yield agricultural fields.

(2) Cultivation, development and production with respect to edible oils, flavourings and industrial raw materials that are from woody plants.

(3) Development and production of non-polluting technologies for, and product serialization of, vegetables (including edible fungi, watermelons and musk melons), dried and fresh fruits, and tea.

(4) Development and production of new technologies for crops such as sugar, fruit trees and herbage.

(5) Production of flowers and plants and the construction and operation of nursery centres.

(6) Planting of rubber, sisal and coffee.

(7) Growing and breeding of traditional Chinese medicine materials (limited to equity and cooperative joint ventures).

(8) Mulching and comprehensive utilization of crop straw and the development and production of organic fertilizer resources.

(9) Forest (bamboo) planting and breeding of improved varieties, and breeding of new varieties of polyploid trees and genetically modified trees.

(10) Breeding of aquaculture brood stock (not including precious and fine varieties unique to China).

(11) Construction and operation of ecological environment protection projects such as the planting of trees and grasses to prevent and treat desertification and prevent water loss and soil erosion.

(12) Breeding of aquaculture products, deep water net-pen breeding, industrialization aquaculture, and ecological marine cultivation and breeding.

2. Mining

(1) Exploration for, and development of, coalbed methane, and utilization of mine gas (limited to equity and cooperative joint ventures).

(2) Risk exploration and development of petroleum and natural gas (limited to equity and cooperative joint ventures).

(3) Development of oil/gas pools (fields) in low permeability formations (limited to equity and cooperative joint ventures).

(4) Development and application of new technologies for increasing the crude oil recovery factor and of other relevant new technologies (limited to equity and cooperative joint ventures).

(5) Development and application of new technologies for petroleum exploration and development such as geophysical prospecting, drilling, logging, downhole operation, etc. (limited to cooperative joint ventures).

3. Manufacturing

(1) Processing of Agricultural Non-staple Foodstuffs.

(i) Development and production of biological feeds, straw feeds and aquaculture feeds.

(ii) Processing of aquatic products, cleansing and processing of shellfish and development of functional foods made from kelp.

(iii) Storage and processing of vegetables, dried and fresh fruits, poultry and livestock products.

(2) Foodstuff Manufacturing

(i) Development and production of infant and geriatric foodstuffs and functional foods.

(ii) Development, production and processing of forest foodstuffs.

(iii) Production of natural food additives, food ingredients (limited to equity and cooperative joint ventures).

(3) Beverage Manufacturing

(i) Development and production of fruit, vegetable, protein, tea, coffee and plant-based beverages.

(4) Tobacco Processing

(i) Processing of diacetate cellulose and tow (limited to equity and cooperative joint ventures).

(ii) Production of tobacco sheet by paper-making process (limited to equity and cooperative joint ventures).

(iii) Processing and production of filter tips (limited to equity and cooperative joint ventures).

(5) Textile Industry

(i) Production of special textile products for industries using high and new technology.

(ii) Weaving, dyeing and finishing of high-grade lining fabric.

(iii) Processing of special natural fibre (including animal fibres other than wool, hemp fibre, bamboo fibre, mulberry silk, coloured cotton, etc.) products that satisfy ecological, resource comprehensive utilization and environmental protection requirements.

(iv) Apparel production using computer integrated manufacturing systems.

(v) Production of high-end carpets, embroidery and drawnwork products.

(6) Leather, Fur, Feathers (Down) and Their Products Industry

(i) Processing of leather and fur using clean technologies.

(ii) Leather finishing using new technologies.

(iii) Processing of high-end leathers (e.g. sofa leather, car seat leather).

(7) Lumber Processing and Wooden, Bamboo, Rattan, Coir and Grass Product Industry

(i) Development of new technologies for the comprehensive utilization of the three forestry residues (i.e. residues from cutting, bucking and processing), secondary wood, small wood, fuel wood and bamboo from forest areas, and the development and production of new products from such comprehensive utilization.

(8) Paper-Making and Paper Product Industry

(i) Production of chemical wood pulp on production lines each with an annual production capacity of at least 300,000 tonnes or chemi-mechanical wood pulp on production lines each with an annual production capacity of at least 100,000 tonnes accompanied by the production of high-end paper and cardboard in projects that integrate forestry and paper (limited to equity and cooperative joint ventures).

(9) Petroleum Processing and Coking Industries

(i) Processing of needle coke and coal tar into downstream products.

(10) Chemical Raw Material and Chemical Product Manufacturing

(i) Scale annual production of 800,000 tonnes or more of ethylene (the Chinese party shall hold a dominant position).

(ii) Processing and manufacture of downstream product derivatives of ethylene and comprehensive utilization of ethylene by-products C4-C9 products (with the exception of butadiene generated synthetic rubber).

(iii) Annual production of 200,000 tonnes or more of PVC resins (by ethylene method).

(iv) Production of further processed products of sodium-process calcium hypocholorite, polyvinyl chloride and organic silicon.

(v) Production of such basic organic raw materials for the chemical industry as benzene, methylbenzene, dimethylbenzene and ethylene glycol and their derivatives.

(vi) Ancillary raw materials for synthetic materials: production of biphenol A, production of propylene oxide by the propylene peroxidation and hydroxidation method.

(vii) Raw materials for synthetic fibres: production of refined terephthalic acid, caprolactam, nylon 66 salt and melt extruded polyurethane resin.

(viii) Synthetic rubber: production of solution styrene butadiene rubber (excluding thermoplastic styrene butadiene rubber), butyl rubber, isoprene rubber, polyurethane rubber, acrylic rubber, chlorohydrine rubber, ethylene propylene rubber, butadiene acrylonitrile rubber and special rubbers, such as fluororubber and silicon rubber.

(ix) Engineering plastics and plastic alloys: production of products such as polyphenylene oxide (PPO), engineering plastic nylon 11 and nylon 12, polyimide, polysulfone, polyarylate (PAR) and liquid crystal polymers.

(x) Fine chemicals: production of new catalysts, auxiliaries and additives and new technologies therefor; processing technology for the commercialization of dyes (pigments); high-tech chemicals for use in the electronics and paper-making industries; food and feed additives; leather chemicals (with the exception of N-N dimethyl formamide); oil field auxiliaries; surfactants; water treatment agents; adhesives; inorganic fibres and inorganic nanometre materials; as well as treatment and further processing of pigment integument.

(xi) Production of low lag high-wearing carbon black.

(xii) Production of environmentally friendly printing inks and aromatic oils.

(xiii) Production of natural, compound and mono-isolate flavours.

(xiv) Production of high performance coatings, water-based coatings for motor vehicles and ancillary water-based resins.

(xv) Production of fluorochlorohydrocarbon substitutes.

(xvi) Production of organic fluorine series chemicals (with the exception of fluorochlorohydrocarbons, hydrofluorochlorohydrocarbons and perfluoroethylene).

(xvii) Production of fluorine resources recovered from phosphorus chemistry and aluminum smelting.

(xviii) Large-scale production of coal-based chemicals (the Chinese party shall hold a dominant position).

(xix) Development and production of new forestry chemical products and the development of new technologies therefor.

(xx) Production of ionic membranes for caustic soda, inorganic separation membranes and functional diaphragms.

(xxi) Development and production of inorganic, organic and biological films for environmental protection purposes.

(xxii) Development and production of new fertilizers: bio-fertilizers, concentrated potassium fertilizers, compound fertilizers, controllable slow-release fertilizers, compound microbial inoculants, compound microbial fertilizers, straw and refuse decomposition agents, microbial preparations with special functions.

(xxiii) Development and production of new varieties of effective and safe agrochemicals and new preparations of high-performance agrochemicals.

(xxiv) Development and production of biological agrochemicals and biological control products: microbial pesticides, microbial bactericides, agricultural antibiotics, insect pheromones, natural enemy insects and microbial herbicides.

(xxv) Comprehensive use, treatment and disposal of waste gas, waste liquids and waste residue.

(xxvi) Production of organic high polymer materials: modified organic silicon coatings for vessel hulls, coatings for the skin of aircraft, red dye in rare earth cerium sulfide, lead free electronic encapsulating materials, serial photo resist specially for colour plasma displays, ultra-thin fibres having small diameters and high specific surface area, precision fuel filter paper, lithium ion battery membranes, multifunctional compound adjuvants for plastic processing, diglyceride citrate, fludioxonil and cyazofamid.

(11) Medicine Manufacturing

(i) Production of new compound pharmaceuticals or active ingredient pharmaceuticals (including raw pharmaceutical materials and preparations).

(ii) Amino acids: production of serine, tryptophan, histidine, methionine for feed, etc.

(iii) Production of new anti-cancer drugs, new cardio- and cerebro-vascular drugs and new neurological pharmaceuticals.

(iv) Production of new, highly effective and economical contraceptives.

(v) Production of new pharmaceuticals using bio-engineering technology.

(vi) Production of physiologically active pharmaceuticals containing high fluorine, such as heterocyclic fluorides, etc., and intermediates.

(vii) Production of vaccines through genetic engineering (AIDS vaccines, hepatitis C vaccines, contraceptive vaccines, etc.).

(viii) Production of biological vaccines.

(ix) Production of bacillus Calmette-Guerin vaccine and poliomyelitis vaccine.

(x) Development and production of drugs from marine organisms.

(xi) Pharmaceutical preparations: production of new agents and products that use new technologies such as sustained release, controlled release, targeting and transdermal absorption.

(xii) Development and production of new ancillary materials for pharmaceuticals.

(xiii) Production of biomedical materials and products (with the exception of the processing of human corpses and specimens thereof, and human organs and tissues and specimens thereof).

(xiv) Production of raw veterinary antibacterial agents (including antibiotics and chemical synthetics).

(xv) Development and production of veterinary antibacterial drugs, vermifuges, pesticides and coccidiostats, and new forms thereof.

(xvi) Production of new diagnostic reagents.

(12) Chemical Fibre Manufacturing

(i) Production of high and new technology chemical fibres such as differential chemical fibres and aramid fibres, carbon fibres, high tensile high modulus polyethylene and polyphenylene sulfide (PPS).

(ii) Production of environmentally friendly chemical fibres such as cellulose fibres using new solvent methods.

(iii) Production of new polyesters of fibre-grade or for use other than for fibres: Polytrimethylene terephthalate (PTT), polyethylene naphthalate (PEN) and polybutylene terephthalate (PBT).

(iv) Production of new fibre materials by using renewable resources and biomass engineering technologies: polylactic fibre PLA, biological method polyatomic alcohol PDO fibres, etc.

(v) Production of polyamides on production lines each with a daily production capacity of at least 100 tonnes.

(vi) Production of aramid fibres and cord for radial tyres.

(13) Plastic Manufacturing

(i) Development and production of new mulching film products (photodegradable film, multipurpose film and raw materials, etc.) and the development of new technologies therefor.

(ii) Breaking down and reuse of waste plastic material.

(iii) Development of new technologies for plastic soft packaging, and development and production of new products thereof (high separation, multifunctional films and raw materials).

(14) Non-Metallic Ore Product Industry

(i) Development and production of new energy saving and environmentally friendly construction materials: strong, light multi-purpose wall materials, high-grade, environmentally friendly decoration and finishing materials, fine-quality waterproof sealing materials and highly effective thermal insulation materials.

(ii) Production of chemical construction materials that use plastic instead of steel or wood and that offer high energy savings.

(iii) Production of waterproof coiled materials for elastomer, plastomer modified asphalt (annual production of at least 10 million square metres), wide-format (at least 2 metres) high quality ethylene prop-ylene diene monomer rubber waterproof coiled materials and ancillary materials, durable polyvinyl chloride
coiled materials and TPO waterproof coiled materials.

(iv) Production of electromagnetic wave blocking glass, glass substrate used in microelectronics, lead free infrared ray transmitting glass, electronic grade large quartz glass diffusion tubes, super second generation and third generation microchannel plates, optical fibre panels and image inverters, and glass light cones.

(v) Production of glass fibre (direct melting process production lines) and articles of glass-fibre reinforced plastic at an annual output of 50,000 tonnes or more.

(vi) Production of continuous glass fibre strand mats, glass fibre surfacing mats, glass fibre cloth and mats for microelectronics.

(vii) Production of image-carrying bundles and laser optic fibre for medical purposes.

(viii) Annual production of one million pieces or more of sanitary ware.

(ix) Standardized fine manufacture of ceramic raw materials and production of high-grade decoration materials for ceramics.

(x) Production of high-grade refractory materials for use in kilns for cement kilns, high-end (electronic) glass, ceramics, glass fibre and micropore carbon bricks, etc.

(xi) Production of ceramic matrixes, aluminum nitride (AIN) ceramic substrate, porous ceramics for automotive catalytic converters.

(xii) Production of inorganic non-metallic materials and articles: man-made crystals, carbon/carbon composite materials, special types of ceramics, special types of sealing materials, high speed oil seal materials, special types of gelling materials, special latex materials, sonar rubber products, heat insulating materials with a coefficient of heat conductivity of not more than 0.025W/mK at atmospheric temperature.

(xiii) Production of hi-tech compound materials: continuous fibre reinforced thermoplastic compound materials and pre-impregnated materials, process auxiliary materials for the shaping of resin matrix composites capable of withstanding heat > 300°C, resin matrix composite propeller blades, high-end resin matrix composite sports articles, special performance glass fibre reinforced plastic tubes (pressure > 1.2MPa), special function composites and their products, deep water and submarine composite products, composite products for medical and rehabilitation purposes, carbon/carbon composite materials and brake pads, high performance ceramic matrix composites and their products, metal matrix composites and their products, metal laminated composites and their products, ultra-high pressure composite rubber tubing capable of withstanding pressures 320MPa, and tyres for large passenger aircraft.

(xiv) Production of precision high-performance ceramics and functional ceramic raw materials: superfine powdered silicon carbide (SiC) (purity > 99%, average particle diameter < 1µm), superfine powdered silicon nitride (Si3N4) (purity > 99%, average particle
diameter 99.9%, average particle diameter < 0.5µm), low temperature powdered sintered zirconium dioxide (ZrO2) (sintering temperature 99%, average particle diameter < 1µm), powdered rutile TiO2 (purity > 98.5%), white carbon black (particle diameter 99%, particle diameter < 1µm).

(xv) Production of diamond film tools, super-thin artificial diamond saw blades no thicker than 0.3mm.

(xvi) Fine processing of non-metallic ores (super-fine pulverizing, high purity, fine manufacture, modification) into downstream products.

(xvii) Production of ultrahigh power graphite electrodes.

(xviii) Production of pearlescent mica (with a particle diameter of 3-150µm).

(xix) Production of multidimensional, multi-directional integrated weaving fabric and modelling fabric and contoured textiles.

(xx) Non-hazardous disposal of combustible industrial waste and domestic refuse by using new dry process cement kilns.

(15) Non-Ferrous Metal Smelting and Rolling

(i) Production of silicon monocrystals with a diameter of at least 200mm and polished wafers, and polycrystalline silicon.

(ii) Production of hi-tech non-ferrous materials: new high performance hydrogen storage materials, lithium ion battery electrode materials, compound semiconductor materials (gallium arsenide, gallium phosphide, indium phosphide, gallium nitride), high temperature superconducting materials, memory alloys (titanium nickel alloy, copper matrix and iron matrix memory alloys), ultra-thin (nanometer) calcium carbide and ultra-thin (nanometer) crystalline hard alloys, super hard composites, precious metal composites, aluminum foil for heat dissipaters, capacitance aluminum foil for medium and high voltage cathodes, special large aluminum alloy bars, aluminum alloy precision stamp work, overhead lead wires for electrified railways, ultra-thin copper strip, copper alloy materials for corrosion resistant heat exchangers, high performance copper nickel, copper iron alloy strip, beryllium copper strip, wire, tubing and bar processed materials, heat resistant anti-fading tungsten filament, magnesium alloy cast goods, lead free soldering flux, magnesium alloys and their application products, foamed aluminum, titanium alloy strip and titanium welded pipe, nuclear grade zirconium sponge, further processed tungsten and molybdenum products.

(16) Metal Product Industry

(i) Manufacture of new lighter and environmentally friendly materials for automobiles and motorcycles (aluminum sheet for vehicle bodies, aluminum magnesium alloys, aluminum alloy frames for motorcycles, etc.).

(ii) Development and production of construction hardware, water heating apparatus and hardware components.

(iii) Manufacture and processing of metal packaging products (with a thickness of less than 0.3mm) used to package contents such as various types of grains, oils, foodstuffs, fruits, vegetables, beverages and articles of daily use (including the printing of the inner and outer walls of the products).

(17) General Machinery Manufacturing

(i) Manufacture of high-end numerically controlled machine tools and key parts and components: 5-axis ganged numerically controlled machine tools, numerically controlled jig borer machining centres, numerically controlled jig grinders, 5-axis ganged numerically controlled systems and servo devices, high speed super hard cutting tools for precision numerically controlled machining.

(ii) Manufacture of multi-station machines weighing at least 1,000 tonnes.

(iii) Manufacture of equipment for the disassembly and compacting of scrapped vehicles.

(iv) Manufacture of FTL flexible production lines.

(v) Manufacture of vertical multi-jointed industrial robots, welding robots and their welding devices and equipment.

(vi) Manufacture of special processing machinery: sets of laser cutting and welding equipment, laser precision processing equipment, numerically controlled low-speed cross-threading electric-spark line cutting machines and sub-micron grade ultra-fine crushers.

(vii) Manufacture of wheeled or tracked lifting machinery weighing at least 300 tonnes (limited to equity and cooperative joint ventures).

(viii) Design and manufacture of high pressure ram pumps (pressure of 35-42MPa) and motors therefor, low speed high torque motors (pressure of 35-42MPa).

(ix) Manufacture of electrohydraulic proportional servo components.

(x) Design and manufacture of monoblock directional valves (pressure of 21-31.5MPa), pneumatic electromagnetic valves (power of not more than 0.35W) and high frequency electropneumatic valves (200Hz and above).

(xi) Design and manufacture of hydrostatic actuating devices.

(xii) Development and manufacture of non-contact gas film seals (pressure of at least 10MPa), dry gas seals (including testing devices) (pressure of at least 10MPa).

(xiii) Development and manufacture of high polymer material (friction discs, modified phenolic pistons, non-metallic hydraulic master wheel cylinders, etc.) equipment for motor vehicles.

(xiv) Manufacture of third and fourth generation sedan hub bearings (hub bearing functional components with a flange plate and sensor on inner and outer ring of the bearing), bearings for high and medium end machine tools and machining centres (the machining centres have at least three axis ganged functionality, positioning repeatability precision of 3-4µm), bearings for high-speed wire and steel sheet rolling mills (supports and working roller bearings for single track wire rolling mills with a rolling speed of at least 120m/s, thin plate rolling mills with a machined sheet thickness of at least 2 mm), high speed rail bearings (running speed greater than 200km/h), low noise bearing with a vibration value of less than Z4 (Z4, Z4P, V4 and V4P grade), and P4 and P2 grade bearings of various types.

(xv) Manufacture of high-heat resistant insulating materials (insulating grade F or H) and shaped insulators.

(xvi) Development and manufacture of rubber and plastic hydraulic and pneumatic seals.

(xvii) Manufacture of high strength fasteners of 12.9 grade and above.

(xviii) Manufacture of fine cast and fine forged blanks for automobiles and motorcycles.

(xix) Re-manufacture of parts and components for machine tools and motor vehicles (with the exception of the five major assemblies) and for engineering machinery.

(18) Specialized Equipment Manufacturing

(i) Manufacture of mining trackless extraction, loading and transport equipment; mechanical transmission dumpers for mine use with a capacity of 100 tonnes or more; movable crushers; bucket wheel excavators with a capacity of 3,000 m3/hour or more; loaders for mine use with a capacity of 5 m3 or more; and 2,000 kW and above electric traction coal cutting equipment.

(ii) Manufacture of geological surveying and well logging equipment: MEME seismic detectors, digital telemetering seismographs, digital imaging and numerically controlled well logging systems, horizontal well, directional well and drilling devices and apparatus, and MWD logging while drilling instruments.

(iii) Manufacture of oil exploration, drilling, collection and transport equipment: floating drilling systems and floating production systems for working depths of greater than 500 metres, ocean floor oil extraction, collection and transport equipment for working depths of greater than 600 metres, deep sea oil drilling rigs with winch power of greater than 3,000kW, top drive power of greater than 850kW and drilling pump power of greater than 1,800kW, onshore oil drilling rigs and desert oil drilling rigs operating to depths of at least 9,000 metres, 80 tonne and above piston force reciprocal compressors for oil refining apparatus with a capacity of 10 million tonnes per year, numerically controlled deep oil well loggers, equipment for the fixing of shafts with mud during oil drilling.

(iv) System integration, design and manufacture of shield machines with a diameter of at least 6 metres, system integration, design and manufacture of full face hard rock tunnel boring machines (TBM) with a diameter of at lease 5 metres, manufacture of large aperture (at least 1 metre) rotary drilling machines capable of depths greater than 30 metres, design and manufacture of pipe pushers with a diameter of at least 1.2 metres, manufacture of large sets of non-excavating underground pipe laying equipment with a pull back force of at least 200 tonnes, manufacture of underground continuous wall borers, manufacture of automatic horizontal well drilling systems.

(v) Design and manufacture of large sideboom tractors of 100 tonnes or above, and large ditch excavators of 320hp and above.

(vi) Design and manufacture of tracked bulldozers with a ground contract pressure of not more than 0.03MPa and of at least 220hp, and large bulldozers of at least 520hp.

(vii) Design and manufacture of dredging machines capable of dredging at least 100m3/hour, and design and manufacture of mud dredging mechanisms for dredging vessels of 1,000 tonnes or above.

(viii) Design and manufacture of construction equipment for concrete cut-off walls for flood prevention levees.

(ix) Manufacture of underwater earth-rock construction machinery: bulldozers, loaders, excavators, etc., operating in depths less than 9 metres.

(x) Manufacture of equipment for the maintenance and automatic monitoring of highway bridges.

(xi) Manufacture of equipment for highway tunnel operation monitoring, ventilation, disaster prevention and emergency rescue systems.

(xii) Design and manufacture of equipment for large-scale railway construction, machinery for large-scale highway maintenance and safe operation equipment.

(xiii) Manufacture of (asphalt) shingle equipment, production equipment for metal roofs, such as galvanized sheet roofs.

(xiv) Manufacture of on-site polyurethane spray waterproof thermal insulation system equipment that is environmentally friendly and energy saving, formulation technologies and equipment for polyurethane sealing compounds, formulation technologies and production equipment for modified silicone sealing compounds.

(xv) Design and manufacture of sheet bar continuous casting machines, high precision strip rolling mills (thickness accuracy of 10 microns).

(xvi) Manufacture of direct reduced iron and fusion reduced iron equipment.

(xvii) Manufacture of high power direct current arc furnaces of 50 tonnes or above.

(xviii) Manufacture of colour coated or plated steel sheet.

(xix) Manufacture of dressing apparatus for multi-element, fine particle refractory metal ores.

(23) Other Manufacturing Industries

(i) Development and utilization of products incorporating technology for the cleaning of coal and manufacture of the equipment thereof (coal gasification, liquefaction, coal-water slurry, industrial briquettes).

(ii) Coal extraction and washing, and the comprehensive utilization of pulverized coal ash (including de-sulfurized gypsum), coal gangue, etc.

(iii) Production of fully biodegradable materials.

4. Electricity, Gas and Water Production and Supply

(1) Construction and operation of power stations using
integrated gasification combined cycle (IGCC), 300,000kW or above circulating fluidized bed, 100,000kW or above pressurized fluidized bed combustion (PFBC) clean burning technologies.

(2) Construction and operation of back pressure cogeneration plants.

(3) Construction and operation of hydroelectric power stations mainly engaged in the generation of power.

(4) Construction and operation of nuclear power stations (the Chinese party shall hold a controlling interest).

(5) Construction and operation of power stations using new sources of energy (including solar energy, wind energy, magnetic energy, geothermal energy, tidal energy, wave power, biomass energy, etc.).

(6) Seawater utilization (direct utilization of seawater, seawater desalination), industrialization of industrial wastewater treatment, recovery and reuse.

(7) Construction and operation of urban water supply plants.

5. Communications, Transportation, Warehousing and Postal Services

(1) Construction and operation of railway main-line networks (the Chinese party shall hold a controlling interest).

(2) Construction and operation of feeder rail lines, local rail lines and their bridges, tunnels, and ferry and station facilities (limited to equity and cooperative joint ventures).

(3) Comprehensive repair and maintenance of high speed rail, passenger rail and commuter rail infrastructure (the Chinese party shall hold a controlling interest).

(4) Construction and operation of highways, independent bridges and tunnels.

(5) Road freight transportation companies.

(6) Construction and operation of the public terminal facilities of ports.

(7) Construction and operation of civil airports (the Chinese party shall hold a relative controlling interest).

(9) Airline companies for agriculture, forestry and fisheries (limited to equity and cooperative joint ventures)

(1) Accounting and auditing (limited to cooperative joint ventures and partnerships)

(3) Provision of outsourcing for system application management and maintenance, information technology support management, bank back office services, financial settlement, human resource services, software development, call centres, data processing and other information technology and business process outsourcing services.

8. Scientific Research, Technical Services and Geological Surveying Business.

(1) Bio-engineering and biomedical engineering technologies, and technologies for the development of biomass energy resources.

(2) Isotopic, radiation and laser technologies.

(3) Technologies for marine development and marine energy development, technologies for the comprehensive utilization of marine chemical resources, technologies for the development, fine processing and further processing of related products, and technologies for the development of marine pharmaceuticals and biochemical products.

(4) Marine monitoring technologies (marine wave, meteorological, environmental monitoring), and technologies for ocean floor detection and oceanic resource survey and assessment.

(5) Comprehensive utilization of post-desalination concentrated sea water to produce salt, technologies for the high added value utilization of sea water chemical resources, such as the extraction of potassium, bromine, magnesium and lithium and the further processing thereof.

(6) Development technologies for the saving of energy.

CATALOGUE OF INDUSTRIES IN WHICH FOREIGN INVESTMENT IS RESTRICTED

1. Agriculture, Forestry, Animal Husbandry and Fisheries

(1) Selective breeding of new varieties of agricultural crops and the development and production of seeds (the Chinese party shall hold a controlling interest).

(2) Processing of logs from precious varieties of trees (limited to equity and cooperative joint ventures).

(3) Processing of cotton (unginned cotton).

2. Mining

(1) Exploration for, and mining of, special and scarce coals (the Chinese party shall hold a controlling interest).

(2) Exploration for, and mining of, barite (limited to equity and cooperative joint ventures).

(3) Exploration for, and mining of, precious metals (gold, silver, and platinum family).

(4) Exploration for, and mining of, precious non-metallic ores such as diamonds.

(5) Mining and dressing of phosphorus ore.

(i) Processing and production of smashed flue-cured tobacco leaves.

(4) Printing Business and Reproduction of Recording Media

(i) Printing of publications (the Chinese party shall have a controlling interest, except in the printing of package dressing).

(5) Petroleum Processing and Coking Industries

(i) Construction and operation of oil refineries with an annual capacity of up to 8 million tonnes.

(6) Chemical Raw Material and Chemical Product Manufacturing

(i) Production of caustic soda (sodium hydroxide), potash (potassium hydroxide).

(ii) Production of photosensitive materials.

(iii) Production of benzidine.

(iv) Production of chemicals that can readily be used in the production of narcotics (ephedrine, 3,4-methylenedioxy-phenyl-2-propanone, phenyl acetic acid, 1-phenyl-2-propanone, heliotropin, safrole, isosafrole and acetic anhydride).

(v) Production of fluorochlorohydrocarbons or hydrofluorochlorohydrocarbons, perfluoroethylene, aluminum fluoride, and hydrofluoric acid.

(vi) Production of polybutadiene rubber, emulsion polymerized styrene butadiene rubber, and thermoplastic styrene butadiene rubber.

(vii) Production of methyl chlorides (with the exception of monochloromethane), and polyvinyl chloride by the calcium carbide process.

(viii) Production of titanium white using the sulphuric acid-method, and potassium permanganate by the open hearth process.

(ix) Processing of ludwigite.

(x) Production of barium salts and strontium salts.

(7) Medicine Manufacturing

(i) Production of chloromycetin, penicillin G, lincomycin, gentamycin, dihydrostreptomycin, amikacin, tetracycline hydrochloride, terramycin, midecamycin, kitasamycin, cipro-floxacin, norfloxacin and ofloxacin.

(ii) Production of analgin, paracetamol, vitamin B1, vitamin B2, vitamin C, vitamin E, multi-vitamin preparations and orally administered calcium preparations.

(iii) Production of vaccines (with the exception of Bacillus Calmette-Guerin vaccine and poliomyelitis vaccine), bacterial vaccines, antitoxins and toxoids within the State's immunization plan (DPT vaccine and vaccines against measles, encephalitis B, epidemic encephalitis, etc.).

(iv) Production of raw pharmaceutical materials for narcotics and Class 1 psychotropic drugs (the Chinese party shall hold a controlling interest).

(v) Production of blood products.

(vi) Production of non-self decomposing disposable syringes, infusion apparatuses, blood transfusion apparatuses and blood bags.

(8) Chemical Fibre Manufacturing

(i) Production of chemical fibres from conventional chip-spinning.

(ii) Production of viscose staple fibres.

(9) Rubber Manufacturing

(i) Retreading of old tyres (except radial ply tyres), and production of low-performance industrial rubber components.

(10) Non-Ferrous Metal Smelting and Rolling

(i) Smelting of rare metals, such as tungsten, molybdenum, tin (excluding tin compounds), antimony (including antimony oxide and antimony sulfide), etc.

(ii) Smelting of such non-ferrous metals as electrolytic aluminum, copper, lead, zinc, etc.

(iii) Smelting and separation of rare earths (limited to equity and cooperative joint ventures).

(11) Metal Products Industry

(i) Production of containers.

(12) General Purpose Equipment Manufacturing.

(i) Manufacture of various common grade (P0) bearings and parts (ball bearings, ball bearing cages), blanks.

(ii) Manufacture of wheeled or tracked lifting machines of less than 300 tonnes.

(13) Specialized Equipment Manufacturing

(i) Manufacture of middle- and low-grade B-type ultrasound scanners.

(ii) Manufacture of equipment for ordinary polyester filament yarn and staple fibres.

(iii) Manufacture of bulldozers outputting up to 320hp, hydraulic excavators of 30 tonne class and below, wheeled loaders of 6 tonne class and below, levelers outputting up to 220hp, road rollers, fork lifts, 135 tonne class and below self-dumping dump trucks not for roads, machinery and equipment milling and repairing road surfaces, landscaping machinery and attachments, ready-mixed concrete machinery (pitot pumps, mixer trucks, mixing stations, pump trucks).

(14) Transport Equipment Manufacturing

(i) Repair, design and manufacture of ordinary vessels (including sections) (the Chinese party shall hold a controlling interest).

(15) Communications Equipment, Computers and Other Electronic Equipment Manufacturing

(i) Production of satellite television and radio ground receiving facilities and key components.

(ii) Manufacture of fiscal cash registers.

4. Electricity, Gas and Water Production and Supply

(1) Construction and operation of coal fired condensing power stations with a unit capacity of up to 300,000kW, cogeneration plants with coal fired condenser extractor units with a unit capacity of up to 100,000kW for the small grids in Tibet, Xinjiang, Hainan, etc.

(2) Construction and operation of power grids.

5. Communications, Transportation, Warehousing, and Postal Services

(1) Rail freight transportation companies.

(2) Companies engaged in the transportation of passengers by rail (the Chinese party shall hold a controlling interest).

(3) Companies engaged in the transportation of passengers by road.

(4) Cross-border automobile transportation companies.

(5) Companies engaged in transportation by water (the Chinese party shall hold a controlling interest).

(6) Airline companies for photography, prospecting, industry, etc. (the Chinese party shall hold a controlling interest).

(7) Telecommunications companies: Value-added telecommunication services (foreign investment not exceeding 50%), mobile voice and data services falling under basic telecommunication services (foreign investment not exceeding 49%), domestic and international services falling under basic telecommunication services (foreign investment not exceeding 35%, and, not later than December 11 2007, foreign investment will be permitted up to 49%).

6. Wholesale and Retail

(1) Companies engaged in commerce such as those engaged in direct sale, mail order, online sale, franchising, entrusted operations and business management.

(2) Wholesale, retail and distribution of agrochemicals, agricultural film, chemical fertilizers (for chain stores with more than 30 branches selling merchandise of different types and brands from more than one supplier, the Chinese party is required to have a controlling interest).

(3) Distribution of audio and video products (excluding motion pictures) (limited to cooperative joint ventures and Chinese party holding a controlling interest).

(4) Auctioning of goods.

(5) Vessel agency ((the Chinese party shall hold a controlling interest)), ocean shipping tallying (limited to equity and cooperative joint ventures).

(6) Wholesale of oil products and the construction and operation of petrol stations (Where one foreign investor has established a petrol station chain with more than 30 branches selling oil products of different types and brands from several suppliers, the Chinese party is required to have a controlling interest).

7. Financial Industry

(1) Banks, lease financing companies, finance companies, trust and investment companies, and money brokers.

(2) Insurance companies (the foreign investment percentage in a life insurance company may not exceed 50%).

(3) Securities companies (limited to engaging in A share underwriting, B share, H share, sovereign and corporate bond underwriting and trading, with foreign investment not exceeding 1/3) and securities investment fund management companies (foreign investment not exceeding 49%).

(4) Insurance brokerages.

(5) Futures companies (the Chinese party shall hold a controlling interest).

8. Real Property Industry

(1) Development of large tracts of land (limited to equity and cooperative joint ventures).

(2) Construction and operation of high-end hotels, villas, high-end office buildings and international conference centres.

(3) Real property secondary market trading and real property intermediaries or brokerages.

9. Leasing and Commercial Services Business

(1) Legal consultancy.

(2) Market surveys (limited to equity and cooperative joint ventures).

(3) Credit check and rating service companies.

10. Scientific Research, Technical Services and Geological Surveying

(1) Surveying companies (the Chinese party shall have a controlling interest).

(2) Companies engaged in the inspection, appraisal and certification of import and export goods.

(3) Photographic services (including aerial photography and other such special photography services, but excluding aerial photography for cartographic purposes; limited to equity joint ventures).

11. Management of Water Conservancy, Environmental and Public Facilities

(1) Construction and operation of gas, heating and water supply and drainage pipe networks in big cities (the Chinese party shall have a controlling interest).

12. Education

(1) Ordinary high school educational institutions (limited to equity and cooperative joint ventures).

13. Health, Social Security and Social Welfare Industries

(1) Medical institutions (limited to equity and cooperative joint ventures).

14. Cultural, Sports and Leisure Business

(1) Radio or television programme production projects and motion picture production projects (limited to cooperative joint ventures).

(2) Construction and operation of cinemas (the Chinese party shall hold a controlling interest).

(3) Construction and operation of large theme parks.

(4) Performance brokering organizations (the Chinese party shall hold a controlling interest).

(5) Operation of amusement venues (limited to equity and cooperative joint ventures).

15. Other Industries That Are Restricted by the State or by International Treaties Concluded or Acceded to by China.

(1) Breeding and cultivation of valuable and fine varieties that are rare in, or unique to, China (including high-quality genes from the crop and plant cultivation industry, the animal husbandry industry and the aquatic products industry).

(2) Development and production of genetically-modified plant seeds, livestock and poultry breeding stock, aquaculture fingerlings.

(3) Aquatic animal and plant fishing and dredging in China's marine jurisdictional waters and inland waters.

2. Mining

(1) Exploration for, and mining of, tungsten, molybdenum, tin, antimony and fluorspar.

(2) Exploration for, and mining and dressing of, rare earths.

(3) Exploration for, and mining and dressing of, radioactive minerals.

3. Manufacturing

(1) Beverage Manufacturing

(i) Processing of green teas and specialty teas using traditional Chinese processes (famous teas, fermented dark tea, etc.).

(2) Medicine Manufacturing

(i) Processing of Chinese traditional medicinal materials included in the Regulations for the Protection of Wild Medicinal Material Resources and the List of Chinese Rare and Endangered Protected Plants.

(ii) Application of technologies for the processing of soft lozenges of Chinese traditional medicines, such as steaming, parching, frying and calcining and the production of secret formulations of finished Chinese traditional medicines.

(3) Non-ferrous Metal Smelting and Rolling

(i) Smelting and processing of radioactive minerals.

(4) Specialised Equipment Manufacturing

(i) Manufacturing of weapons and ammunition.

(5) Manufacturing of Electric Machinery and Apparatus

(i) Vented (direct emission of acid mist) lead-acid batteries, silver oxide button cell batteries with mercury, pasted zinc-manganese dioxide batteries and nickel cadmium batteries.

(6) Industrial Products and Other Manufacturing Industries

(i) Ivory carving.

(ii) Processing of tiger bones.

(iii) Production of bodiless lacquerware.

(iv) Production of enamelware.

(v) Production of xuan paper, and ingot-shaped ink tablets.

(vi) Production of products that cause cancer, deformity or mutation or that are long-term organic pollutants.

4. Electricity, Gas and Water Production and Supply

(1) With the exception of small grids in Tibet, Xinjiang and Hainan, etc., construction and operation of coal fired condensing power stations with a unit capacity of up to 300,000kW, cogeneration plants with coal fired condenser extractor units with a unit capacity of up to 100,000 kW.

5. Communications, Transportation, Warehousing, and Postal Services

(1) Air traffic control companies.

(2) Postal service companies.

6. Lease and Commercial Service Business

(1) Social surveys.

7. Scientific Research, Technical Service and Geological
Surveying Business.

(1) Development and application of human stem cell, gene diagnostic and treatment technologies.

(2) Geodetic surveying, marine surveying and cartography, aerial photography for cartographic purposes, administrative division boundary surveying and cartography, preparation of topographic maps in the preparation of maps, and preparation of navigational electronic maps in the preparation of ordinary maps.

8. Management of Water Conservancy, Environmental and Public facilities.

(1) Establishment and operation of nature preserves and internationally important wetlands.

(2) Development of state protected wild fauna and flora resources native to China.

9. Education

(1) Mandatory education institutions, educational institutions in special fields such as military academies, police academies, political academies and party schools.

(9) Construction and operation of golf courses.

(10) Gaming industry (including horse racetracks that offer betting).

(11) Sex industry.

11. Other Industries

(1) Projects that jeopardize the safety and efficient use of military facilities.

12. Other Industries That Are Prohibited by the State or by International Treaties Concluded or Acceded to by China.
