Rural Land Rights under the PRC Property Law

This article examines the status of rural property rights and recommends a series of institutional measures including standardizing registration and renewal processes.

The landmark PRC Property Law (中华人民共和国物权法)[Property Law] adopted by China in March became effective on October 1 2007. The legislation sets the record for taking the longest time to be successfully passed, as it took the National People's Congress thirteen years and eight rounds of formal deliberations (versus the usual three for most bills), and also establishes for the first time the legal concept of private property ownership in China.
