Applicability: For the purposes of this Announcement, the term "central and western regions" means regions other than eastern regions. The term "eastern regions" refers to Beijing Municipality, Tianjin Municipality, Shanghai Municipality, Liaoning Province, Hebei Province, Shandong Province, Jiangsu Province, Zhejiang Province, Fujian Province and Guangdong Province (Article 6).
This Announcement does not apply to areas under special customs regulation such as export processing zones and bonded zones, nor does it apply to processing trade under which commodities in the restricted import category are transferred into areas outside such special customs regulatory zones from other areas of China for further processing or commodities in the restricted export category are transferred out of areas outside such special customs regulatory zones to other areas of China for further processing (Article 8).
Main Contents: Enterprises that engage in processing trade for commodities in the restricted category shall be subject to the real deposit account system, i.e. when an enterprise engages in processing trade for commodities in the restricted category and files the contract for the record, it shall pay a deposit into a bank account. The deposit and the interest thereon shall be refunded after the enterprise has exported the processed products and has completed the formalities for verification and reconciliation. Where a business enterprise and its processing enterprise that engage in processing trade business for commodities in the restricted category are both from central and western regions, Types A and B enterprises shall be subject to the administration of keeping a nominal bank account without actually providing any deposit. Type C enterprises shall provide a 100% deposit (Article 2).
A catalogue of commodities newly added to the restricted category for processing trade is appended to the Announcement. The catalogue mainly includes plastic raw materials and the products thereof, textile yarn, cloth, furniture, and metal products that have undergone rough machining.
