Main Contents: Item Two provides the standard for verifying the qualifications of foreign-invested construction design enterprises. Foreign-invested construction design enterprises that fail to meet the requirements in Article 15 of the Provisions for the Administration of Foreign-invested Construction Design Enterprises (the Provisions) for the time being may employ PRC registered architects and China registered engineers to meet the requirements on the number of foreign service providers with the qualifications of a China registered architect or China registered engineer in the Provisions. The requirement on the number of foreign service providers with relevant professional design experience in the Provisions may be satisfied by employing professional technicians who are Chinese nationals. Where a foreign service provider fails to meet the requirements on the duration of residence in Article 16 of the Provisions, the competent construction authority may refuse to grant assessment. The investment in and establishment of construction design enterprises by investors from Hong Kong and Macao Special Administrative Regions and Taiwan in other provinces, autonomous regions and municipalities directly under the central government shall be handled with reference to these Implementing Rules (Section Four).
