Stricter rules for export of automobiles.

Main Contents: Whole motor vehicle products (including passenger motor vehicles, commercial motor vehicles, chassis and a whole set of spare parts) shall be subject to export licensing.

To apply for export licences for whole vehicle products, an automobile manufacturer shall be listed in the Gazette of Vehicle Manufacturers and Products issued by the National Development and Reform Commission, have passed the China Compulsory Certification and remain qualified, have the capability to provide maintenance and repair services commensurate with the volume of on-road exported vehicles, and have established sound sales service systems in major export markets.

Automobile manufacturers (independent legal person enterprises) established in export processing zones and approved by the state to export all their products are not bound by the aforementioned restrictions. As in the case of export enterprises (including import and export subsidiaries of automobile enterprise groups), they shall have the authorization to export granted by an automobile manufacturer qualified for export and shall export the manufacturer's products according to the authorization. Export enterprises and automobile manufacturers shall stipulate in the authorization agreement joint and several liability such as joint assumption of quality assurance and after-sales services for the exports (Section One).
