General Administration of Civil Aviation of China, Provisions for Limits on the Liability for Compensation of Domestic Air Carriers

Applicability: These Provisions apply to compensation for damage occurred in the course of air transportation in the PRC (Article 2).

Main contents: Domestic air carriers (Carriers) shall, based on the actual damage, bear liability for compensation within the limits of liability for compensation stipulated in the following, unless otherwise provided by the PRC Civil Aviation Law:
(1) the limit of liability for compensation payable to every passenger is Rmb400,000; (2) the limit of liability for compensation payable for every passenger's cabin baggage shall be Rmb3,000; (3) the limit of liability for compensation payable for passengers' check-in baggage or payable for cargoes transported shall be Rmb100 per kilogramme. Where a person has personally purchased personal accident insurance for air passengers from an insurance company, the payment of insurance benefits from such insurance shall not exempt or reduce the liability for compensation that shall be borne by the Carrier (Article 5).
