General Administration of Quality Supervision, Inspection and Quarantine, Implementing Measures for the PRC Regulations for the Administration of Industrial Product Production Permits

Applicability: The administration of food production permits shall be under separate provisions (Article 121).

Main contents: Part Two of the Implementing Measures detail the procedures for obtaining a production permit. Conglomerates and their subsidiaries, branches or production bases (hereinafter collectively referred to as 'Subordinate Work Units') with legal personality, may independently apply for production permits. Those without legal personality may not independently apply for production permits in name of Subordinate Work Units. All subordinate work units, whether with legal personality or not, may jointly apply for production permits with their conglomerates (Article 40). The entrusting and entrusted enterprises engaging in entrusted processing of products subject to the administration of the production permit system shall respectively apply for record filing with the provincial-level permit offices at the places where they are located (Article 45).
The entrusting enterprise must be a lawfully operating enterprise and the entrusted enterprise must possess a legal and valid production permit (Article 46). Enterprises that have obtained a production permit shall finish affixing the production permit mark and serial number on their products or packaging and on the instruction manuals within 6 months from the date of grant of the permission (Article 91).
