Applicability: This Circular applies to the grant of state-owned leaseholds within the administrative jurisdiction of the municipality by way of invitation for bids, auctions and listing (Article 2).

Main contents: Land for commercial, tourist, entertainment, commodity residential premises development and other for-profit purposes shall be granted by invitation for bids, auctions or listing (Article 7). Domestic and overseas companies, enterprises, other organizations and individuals may, in accordance with these Measures, participate in activities relating to invitation for bids, auctions and listing for the grant of state-owned leaseholds, unless otherwise stipulated by the law (Article 8). Part Two details the invitation for bids for state-owned leaseholds. Where there are fewer than three bidders, the bid inviting party shall stop opening of the bids and shall start anew the invitation for bids, auction or listing for the grant of state-owned leaseholds in accordance with these Measures (Article 20). Part Three concerns auctions of state-owned leaseholds. Where there are fewer than three auction bidders, or where the highest bidding price (bid price) falls short of the reserve price, the auctioneer shall terminate the auction (Article 30). Part Four concerns listing of state-owned leaseholds. For listing and trading, the listing period shall not be less than 10 working days (Article 37).
