Ministry of Communications, Supervision of the Quality of Highway Projects Provisions

Applicability: The term 'highway projects' refers to such projects as new construction, reconstruction, and maintenance and overhaul of highways (Article 2). Relevant provisions promulgated before the implementation of the Provisions that are in conflict with the Provisions shall no longer be implemented as of the effective date of the Provisions.

Main contents: The Provisions state that construction employers, survey and design work units, construction work units, supervisory work units, testing work units and related equipment and material supply work units engaging in highway construction projects (the Engaged Work Units) shall bear the responsibility of the quality of highway projects in accordance with the law (Article 4). The supervision of highway project quality mainly includes the following: (1) the enforcement of laws, regulations, rules, technological standards and guidelines on the administration of project quality; (2) the quality assurance systems of the Engaging Work Units and the operation thereof; (3) survey and design quality, project quality, and the quality of material and equipment employed; (4) the testing work of the project; (5) the truthfulness, completeness, compliance and legality of the information on project quality; and (6) the quality of the Engaged Work Units in the course of the project (Article 6). Before the acceptance check for a completed highway project, the quality supervision institutions shall carry out quality appraisal of the project and issue a quality appraisal report. No acceptance check may be organized for projects that have not been subject to quality appraisal, or projects that fail quality appraisal (Article 20).
