关于非公有资本进入文化产业的若干决定

The Decisions state that the entry of non-upblicly owned capital into specified cultural sectors is encouraged and supported.

People's governments of the provinces, autonomous regions and municipalities directly under the central government, ministries and commissions of the State Council and agencies directly subordinate to the State Council:

各省、自治区、直辖市人民政府,国务院各部委、各直属机构:

We hereby render the following decisions on relevant issues in order to vigorously develop advanced socialist culture, to fully mobilize the energy of the entire populace to participate in cultural development, and to further guide and regulate the entry into the cultural sector of non-publicly owned capital so as to progressively give rise to a cultural sector in which public ownership dominates but in which several types of ownership jointly contribute to its development and to increase the overall strengths and competitiveness of China's cultural sector.

为大力发展社会主义先进文化,充分调动全社会参与文化建设的积极性,进一步引导和规范非公有资本进入文化产业,逐步形成以公有制为主体、多种所有制经济共同发展的文化产业格局,提高我国文化产业的整体实力和竞争力,现就有关问题作出如下决定:

1. The entry of non-publicly owned capital into the following sectors is encouraged and supported: performing arts troupes, performance establishments, museums, exhibition halls, places of business that provide internet access services, art education and training, culture and art intermediaries, tourism and cultural services, culture and entertainment, dealing in works of art, animated and online games, advertising, motion picture and television drama production and distribution, broadcast, film and television technology development and application, movie theatres and cinema lines, film projection in rural areas, distribution of books, newspapers and periodicals, distribution of audio and video products, printing of packaging and printed materials, etc.

一、  鼓励和支持非公有资本进入以下领域:文艺表演团体、演出场所、博物馆和展览馆、互联网上网服务营业场所、艺朮教育与培训、文化艺朮中介、旅游文化服务、文化娱乐、艺朮品经营、动漫和网络游戏、广告、电影电视剧制作发行、广播影视技朮开发运用、电影院和电影院线、农村电影放映、书报刊分销、音像制品分销、包装装潢印刷品印刷等。

2. The entry of non-publicly owned capital into the export of cultural products and cultural services is encouraged and supported.

二、  鼓励和支持非公有资本从事文化产品和文化服务出口业务。

3. The participation of non-publicly owned capital in the restructuring of state-owned cultural work units, such as performing arts troupes, performance establishments, etc., into companies is encouraged and supported and non-publicly owned capital may take a controlling interest therein.

三、  鼓励和支持非公有资本参与文艺表演团体、演出场所等国有文化单位的公司制改建,非公有资本可以控股。

4. The entry of non-publicly owned capital into such cultural industries and sectors as the printing of publications, production of recordable optical discs, reproduction of read-only optical discs, etc. is permitted.

四、  允许非公有资本进入出版物印刷、可录类光盘生产、只读类光盘复制等文化行业和领域。

5. Non-publicly owned capital may be invested in or take an equity interest in state-owned cultural enterprises in the following sectors: printing and distribution of publications, advertising and distribution of news agencies, the production of music, science and technology, sports and entertainment programmes for radio and television stations and the production, distribution and projection of motion pictures. State-owned capital must have a controlling interest of at least 51% in the aforementioned cultural enterprises.

五、  非公有资本可以投资参股下列领域国有文化企业:出版物印刷、发行,新闻出版单位的广告、发行,广播电台和电视台的音乐、科技、体育、娱乐方面的节目制作,电影制作发行放映。上述文化企业国有资本必须控股51%以上。

6. Non-publicly owned capital may be used to establish and operate cable television access networks and participate in the digitization of cable television receivers. State-owned capital must have a controlling interest of at least 51% in cultural enterprises engaging in the aforementioned businesses. Non-publicly owned capital may have a controlling interest in enterprises which engage in the community end of the business of a cable television access network.

六、  非公有资本可以建设和经营有线电视接入网,参与有线电视接收端数字化改造,从事上述业务的文化企业国有资本必须控股51%以上。非公有资本可以控股从事有线电视接入网社区部分业务的企业。

7. Non-publicly owned capital may be used to engage in the business of display screen advertising outdoors, inside buildings, on means of transport, in shops, etc. and the provision of broadcast television video-on-demand services in qualified guest houses and hotels. The relevant departments shall be stringent in their certification of qualifications, expressly specify the scope of business and strengthen routine oversight thereof.

七、  非公有资本可以开办户外、楼宇内、交通工具内、店堂等显示屏广告业务,可以在符合条件的宾馆饭店内提供广播电视视频节目点播服务。有关部门要严格资质认定,明确经营范围,加强日常监管。

8. The entry into the cultural sector by non-publicly owned capital shall be administered in accordance with current relevant provisions. The items specified in Articles 5, 6 and 7 shall additionally require the approval of the competent administrative department. The examination and approval, or verification, of relevant investment projects shall be handled in accordance with the State Council, Reform of the Investment System Decision (ref. Guo Fa [2004] No.20). The examination and approval procedure shall be carried out stringently, examination and approval measures shall be improved, the development of the cultural sector regulated, the lawful rights and interests of enterprises protected and illegal operations closed down. Non-publicly owned cultural enterprises shall enjoy the same treatment as state-owned cultural enterprises in terms of project examination and approval, certification of qualifications, financing, etc.

八、  非公有资本进入文化产业按现行有关规定管理,其中第五条、第六条、第七条规定的事项还须经有关行政主管部门批准。有关投资项目的审批或核准,按照《国务院关于投资体制改革的决定》(国发〔2004〕20号)的规定办理。要严格审批程序,完善审批办法,规范文化产业发展,保护企业合法权益,取缔违法违规经营。非公有制文化企业在项目审批、资质认定、融资等方面与国有文化企业享受同等待遇。

9. Non-publicly owned capital may not be invested in the establishment and operation of news agencies, newspapers or periodicals, publishing houses, radio stations (sub-stations), television stations (sub-stations), radio and television transmitting stations (sub-stations), relay stations (sub-stations), radio and television satellites, satellite up-link stations and pickup stations, microwave stations, monitoring stations (sub-stations), trunk cable television transmission networks, etc.; may not utilize information networks to provide audio-visual programme services, news websites or other such services; may not operate newspaper or periodical pages, radio or television frequencies or channels, or time slots; may not engage in the import of such cultural products as books, newspapers and periodicals, films and television programmes or finished audio and video products; and may not be invested in state-owned historical museums.

九、  非公有资本不得投资设立和经营通讯社、报刊社、出版社、广播电台(站)、电视台(站)、广播电视发射台(站)、转播台(站)、广播电视卫星、卫星上行站和收转站、微波站、监测台(站)、有线电视传输骨干网等;不得利用信息网络开展视听节目服务以及新闻网站等业务;不得经营报刊版面、广播电视频率频道和时段栏目;不得从事书报刊、影视片、音像制品成品等文化产品进口业务;不得进入国有文物博物馆。

10. The Ministry of Culture, the State Administration of Radio, Film and Television and the General Administration of Press and Publishing shall formulate specific implementing procedures pursuant to these Decisions, specify lists of sectors in which the state encourages, permits, restricts and prohibits investment and guide the continued rapid and healthy development of non-publicly owned cultural enterprises.

十、  文化部、广电总局、新闻出版总署根据本决定,制定具体实施办法,明确国家鼓励、允许、限制和禁止投资的产业目录,引导非公有制文化企业持续快速健康发展。

Local governments and departments shall screen and revise in accordance with the law provisions which conflict with these Decisions. The entry of foreign capital into the cultural sector shall be handled in accordance with relevant laws and regulations.

各地区、各部门要依法清理和修订与本决定相抵触的规定。外资进入文化产业依照有关法律法规的规定执行。
