State Administration for Industry and Commerce, Procedure for Enterprise Registration Provisions

Effective: July 1 2004
Applicability: The provisions are applicable to the establishment registration, modification registration and deregistration of enterprises, as well as the preliminary verification of enterprise names (Article 2). The term "enterprises" referred to in the Provisions includes various types of enterprises and their branches and sub-branches (Article 22). The registration of enterprise groups, resident representative offices of enterprises from foreign countries (regions) and enterprises from foreign countries (regions) engaging in production and business activities in China shall be conducted with reference to the Provisions (Article 23).

Main contents: Applicants and their appointed agents may file their registration applications using the following methods: 1) applying directly at the enterprise registration venue; 2) applying by post, facsimile, electronic data exchange, electronic mail, etc. (Article 6). Except for registration in person, the time period for various types of enterprise registration is standardized to 15 days (Article 12).
