Shanghai Municipality, Administration of Control on the Scale of Land Use in the Examination and Approval of Construction Projects Trial Procedures

Interpreting authority: Specific application of the Procedures shall be interpreted by the Shanghai Municipal Development and Reform Commission, the Shanghai Urban Planning Administration Bureau and the Shanghai Municipal Housing, Land and Resources Administration in accordance with their respective duties (Article 11).
Applicability: The Procedures apply to control on the scale of land use in the examination and approval of the following fixed asset investment construction projects within the Shanghai Municipality: (1) units that are newly built or relocated that require the use of land, (2) expansion of construction in the original site that requires the use of additional land other than that of the original unit, and (3) where alteration on the nature of land use of the original unit is necessary (Article 2).

Main contents: The department in charge of investment of the municipality or departments and work units authorized by the municipal government with examination and approval, and departments in charge of land and planning shall, in accordance with their powers, reinforce the control and verification on the scale of land use in the course of examination and approval, planning and selection of sites, and preliminary examination of land use, of fixed asset investment construction projects, respectively (Article 3).
