Establishment of Foreign-controlled and Wholly Foreign-owned Travel Agencies Tentative Provisions
设立外商控股、外商独资旅行社暂行规定
A set of regulations which governs the procedures and requirements of establishing Foreign-controlled and Wholly Foreign-owned Travel Agencies.
(Promulgated by the China National Tourism Administration and the Ministry of Commerce on June 12 2003 and effective 30 days thereafter.)
Article 1: These Provisions have been formulated in accordance with relevant Chinese laws on foreign-invested enterprises, the Administration of Travel Agencies Regulations and relevant provisions, in order to adapt to the new situation after China's accession to the World Trade Organization, further expand the opening of the tourism industry to the outside world and promote the development of the tourism industry.
(国家旅游局、商务部于二零零三年六月十二日公布，自公布之日起30日后施行。)
第一条 为适应中国加入世界贸易组织的新形势，进一步扩大旅游业对外开放，促进旅行社业发展，根据中国外商投资企业的相关法律、《旅行社管理条例》及有关规定，制定本《规定》。
Article 2: These Provisions apply to the establishment of foreign-controlled or wholly foreign-owned travel agencies within the territory of the People's Republic of China during the transition period before the time limit prescribed by China's WTO accession commitments.
第二条 在中国有关入世承诺规定期限之前的过渡期内，在中华人民共和国境内设立外商控股或外商独资的旅行社，适用本《规定》。
Article 3: A foreign investor of the foreign-controlled travel agency to be established shall comply with the following conditions:
