Applicability: The Measures apply to applications for international registration of marks of which China is the country of origin, requests for territorial extension to China and other related applications (Article 2).
Main contents: An applicant for international registration of marks of which China is the country of origin must have a real and effective industrial or commercial establishment or have his domicile in China or be a Chinese national and his marks must have been registered or a mark registration have been applied for with the Trademark Office of the Industry and Commerce Administrative Department of the State Council (Trademark Office) (Articles 3 and 4). Applications for international registration of marks or applications for subsequent designation, renunciation and cancellation of international mark registrations pertinent to the Madrid Agreement Concerning the International Registration of Marks shall be made through the Trademark Office (Article 6). Relevant application Measures are provided for in Articles 7-20.
