Reform of State Council Organs Plan
国务院机构改革方案
Following the 16th National Congress of the Communist Party in November 2002, the NPC issued the reform plan which reflects China's interest in developing a "market economy with socialist characteristics." Particularly, a number of government bodies are merged into a new Ministry of Commerce (MOFCOM).

According to the mission to intensify the reform of the administrative system proposed in the 16th National Congress of the Communist Party and the Intensifying the Reform of the Administrative System and Organs Opinion deliberated and adopted by the Second Plenary Session of the 16th Central Committee of the Communist Party of China, the major missions of this reform of State Council organs are:
1. intensifying the reform of the administrative system for State-owned assets and establishing the State Council State Asset Supervision and Management Commission;
2. improving the macro-economic control mechanism and reorganizing the State Development Planning Commission into the State Development and Reform Commission;
3. strengthening the financial regulatory system and establishing the China Banking Regulatory Commission;
4. continuing to carry forward the reform of the administrative system for the circulation of merchandise and organizing the establishment of the Ministry of Commerce;
5. strengthening the establishment of the regulatory system for food safety and safe production, organizing the establishment of the State Food and Drug Administration on the basis of the State Drug Administration and changing the State Administration of Work Safety administered by the State Economic and Trade Commission into an organ directly under the State Council;
6. changing the name of the State Family Planning Commission to State Population and Family Planning Commission; and
7. no longer keeping the State Economic and Trade Commission and the Ministry of Foreign Trade and Economic Cooperation.
After the reform, apart from the State Council General Office, the component departments of the State Council are as follows:
1. Ministry of Foreign Affairs of the People's Republic of China;
2. Ministry of National Defence of the People's Republic of China;
3. State Development and Reform Commission of the People's Republic of China;
4. Ministry of Education of the People's Republic of China;
5. Ministry of Science and Technology of the People's Republic of China;
6. Commission of Science, Technology and Industry for National Defence of the People's Republic of China;
7. State Ethnic Affairs Commission of the People's Republic of China;
8. Ministry of Public Security of the People's Republic of China;
9. Ministry of State Security of the People's Republic of China;
10. Ministry of Supervision of the People's Republic of China
11. Ministry of Civil Affairs of the People's Republic of China;
12. Ministry of Justice of the People's Republic of China;
13. Ministry of Finance of the People's Republic of China;
14. Ministry of Personnel of the People's Republic of China;
15. Ministry of Labour and Social Security of the People's Republic of China;
16. Ministry of Land and Resources of the People's Republic of China;
17. Ministry of Construction of the People's Republic of China;
18. Ministry of Railways of the People's Republic of China;
19. Ministry of Communications of the People's Republic of China;
20. Ministry of Information Industry of the People's Republic of China;
21. Ministry of Water Resources of the People's Republic of China;
22. Ministry of Agriculture of the People's Republic of China;
23. Ministry of Commerce of the People's Republic of China;
24. Ministry of Culture of the People's Republic of China;
25. Ministry of Health of the People's Republic of China;
26. State Population and Family Planning Commission of the People's Republic of China
27. People's Bank of China; and
28. National Audit Office of the People's Republic of China
According to the provisions of the Organization of the State Council Law, the adjustment and establishment of the component departments of the State Council shall be deliberated and approved by the National People's Congress. The examination and approval for the establishment of the State Council State Asset Supervision and Management Commission and the China Banking Regulatory Commission, the organization of the establishment of the State Food and Drug Administration, and the adjustment of the structure of the State Administration of Work Safety will be carried out by the newly formed State Council.
