Procedural requirements for the establishment of certification institutes, training centers and consultancies in China.

Main contents: The Circular elaborates on articles in the Administration of the Examination, Approval, Registration and Regulation of Certification Institutions, Certification Training Institutions and Certification Consulting Institutions Procedures (the Procedures) regarding the requirements for the establishment of certification institutions, certification training institutions and certification consulting institutions, and the applications materials required thereof. The registered capital of a certification institution, a certification training institution and a certification consulting institution should be at least Rmb3 million, Rmb1 million and Rmb500,000 respectively.
Part Four regards the establishment of certification institutions, certification training institutions and certification consulting institutions that are foreign-funded (including equity and cooperative joint institutions and wholly foreign-funded institutions). This Part states that, in addition to the documentation specified in Parts One to Three, the applicant shall also submit to the examination and approval authority such documents as a copy of the joint venture contract, the project proposal and the feasibility study report; credit certification for both parties, and the foreign investor's certification qualification or proof of certification from its home country.
Part Five pertains to the establishment in China of representative agencies for foreign certification institutions, certification training institutions and certification consulting institutions and elaborates on Articles 21-22 of the Procedures. It lists the documents required to be submitted to the examination and approval authority. For instance, it requires that the application be signed by the chairman or general manager of the foreign institution, and include the name of the institution to be established, the scope of operation and the period of operation. Certification from the responsible government authority in the home country is also required.
