Regulations of audio-video product content, establishment requirements and operation procedures.

Applicability: The Procedures apply to the wholesale, retail or rental of audio tapes, video tapes, records and laser disks containing recorded audio and video contents (Article 2).

Main contents: The Procedures prohibit content in audio and video products that contradicts the provisions of the Constitution; reveals State secrets; or that publicizes cults or superstition (Article 4).
Part Two of the Procedures deals with the establishment of enterprises engaged in the wholesale, retail or rental of audio and video products. It requires that a wholesaler have a registered capital of Rmb1 million (Article 9) and a retail or rental enterprise have a registered capital and professional personnel suitable to the scale of the operation (Article 11). Article 14 requires that an audio and video chain outlet have a registered capital of Rmb5 million or, when of national scale, Rmb30 million and at least ten outlets. Individual chain outlets can be fully- or majority-owned and managed by the head office, or can share a contract relationship with the head office by which the outlet enjoys use of a trademark, name, operational expertise and other facilities (Article 18). Enterprises engaged in wholesale, retail or rental of audio and video products through the internet must hold an Audio and Video Product Business Permit (Article 19).
Part Three deals with general operation and government administration. Article 20 states that wholesale, retail and rental enterprises shall not handle materials by an unauthorized producer, unauthorized imported materials, or imported reference materials for research and education. Article 24 states that audio and video products must bear a stamp of the Ministry of Culture affirming non-counterfeit status. Article 31 stipulates that audio and video product manufacturers are prohibited from engaging in wholesale, retail or rental.
