Applicability: The Code also applies to articling law students and legal assistants (Article 46).
Main contents: The Code represents the rules of conduct that all practising lawyers shall abide by. A lawyer shall not practise in two or more law firms simultaneously and shall not accept client instructions in his own name (Articles 14 and 15). In litigation or arbitration activities, a lawyer shall not contact the judges, prosecutors or arbitrators involved in his cases outside their offices or provide gifts, promises or other conveniences to such persons for the purpose of influencing their judgments or decisions in the case (Article 20). A lawyer shall not advertise and exploit his special relationship with law enforcement personnel and other related personnel (Article 21). A lawyer shall not act for both sides in a case (Article 28). A lawyer shall exercise reasonable care and practise economy when charging his legal fees (Article 29). A lawyer's obligation of confidentiality to a client shall survive his working relationship with the client (Article 39). A lawyer shall not use name cards showing his academic, social or honorary titles that are not related to the legal profession or substantially undercharge his legal fees for the purpose of unfair competition (Article 44).
