State General Administration for Quality Supervision and Inspection and Quarantine, Administration of State-supervised Sample Testing of Product Quality Measures

Applicability: The Measures apply to State-supervised sample testing of product quality (Article 2). State-supervised sample testing refers to, in relation to products being produced or sold, the sampling and testing of such products by a provincial quality supervision department as arranged by the State Council's product quality supervision department (Article 3).

Main contents: The State General Administration for Quality Supervision and Inspection and Quarantine shall formulate a Catalogue of Key Products Subject to State-supervised Sample Testing that mainly include products that may affect health, safety or State interest (Article 12). In State-supervised sample testing, product quality can be determined on the basis of the relevant national standard, industry standard, local standard or expressed enterprise standard or quality assurance. Expressed enterprise standards or quality assurances may generally be applied except where provisions related to safety and health standards are less stringent than those of mandatory standards (Article 7). No repeated sample testing shall be conducted on the same product within six months (Article 11). Measures for taking samples, testing, lodging a protest against test results and disclosure of test results are separately dealt with by the Measures (Part Three to Part Six).
