Applicability: "Environmental protection products" refer to equipment, instruments and related chemicals and materials which are used to prevent and treat environmental pollution, improve the ecological environment and protect natural resources (Article 3).
Main contents: The administrative department of the State Council in charge of environmental protection shall formulate guidelines and technical requirements for recognition of environmental protection products and catalogues of products eligible for such recognition (Article 5). Institutions engaging in the recognition of environmental protection products shall be third party institutions independent from the suppliers and users of such products (Article 7). An enterprise applying for recognition of a product as an environmental protection product may not have been subject to punishment by the local administrative department in charge of environmental protection in the year before the application (Article 9). The recognition institution shall conduct an on-site inspection of the enterprise and take random samples of the product for testing (Article 13). If the enterprise and the product meet the requirements, the recognition institution shall issue an Environmental Protection Product Certificate for the product (Article 15). Such certificate is valid for three years and can be used on the packaging of, and the advertisement for, the products (Articles 17 and 19). Users of the product may appeal to the recognition institution if they object to the recognition (Article 30).
