State Environmental Protection Administration, Administration of Environment-related Acceptance of Construction Projects Measures

Applicability: The Measures are for use where an administrative department in charge of environmental protection conducts the environment-related acceptance at the completion of a construction project and approves the environmental impact report or a environmental impact registration (Article 2).

Main contents: Whether for regular operation or a trial operation period, environmental protection facilities must enter operation at the same time as the principal structure (Article 6). The construction work unit must apply to the relevant environmental protection department for approval of a trial operation period (Article 7), after which an inspection of the production and environmental protection facilities will be conducted within 30 days (Article 8).
After completing a construction project, the construction work unit is required to submit an application for inspection (Article 9). When a trial operation period has been approved, the construction work unit is required to file its application for inspection within three months after the initiation of the trial period; an extension of the trial period can be granted for up to one year (Article 10). The environmental protection department shall finish acceptance within 30 days of receiving an application for acceptance (Article 14).
Items to be inspected include the supporting documentation, the completeness and suitability of the environmental facilities, conformity with industry standards and operating conditions (Article 16).
