Rules regarding the construction of telecommunication networks and radio and TV transmission networks.

Applicability: The Measures apply to all new construction and upgrading or expansion of public telecommunications networks, dedicated telecommunications networks and radio and television transmission networks in the PRC (Article 2).

Main contents: Entities proposing to construct public telecommunications networks or radio or television transmission networks shall draw up five-year development plans and annual rolling plans (including transmission network special plans) in accordance with the telecommunications sector development plans of the Ministry of Information Industry (MII) and the relevant provincial telecommunications administrations. Entities proposing to construct dedicated telecommunications networks shall draw up five-year development plans and annual rolling plans in accordance with their needs for transmission lines and bandwidth (Article 7). These plans shall be filed with, or submitted for approval to, the State Development Planning Commission, MII or provincial telecommunications administration (Article 12). Individual projects under the plans shall still be subject to preliminary examination by and filing with the telecommunications authorities; approval of a transmission network rolling plan may be deemed preliminary approval of individual projects under a plan (Articles 17, 18 and 19). Providers of basic telecommunications services may construct and operate telecommunications facilities within the scope of their licences (Article 25). Operators or managers of public places have an obligation to assist providers of basic telecommunications services in constructing telecommunications facilities (Article 27). Entities contracting for telecommunication network construction shall be examined and approved by MII or provincial telecommunications administrations (Article 36).
