Applicability: These Measures are applicable where personal credit information collection and rating is conducted in Shenzhen (Article 2). For the purposes of the Measures, "personal credit information collection" means the collection by a collection institution of personal credit information from various commercial banks and other information providers and the storage of the same in a personal credit data bank; a "collection institution" means a legal person entity established under these Measures to collect personal credit information and provide such information and credit rating services to commercial bank and other personal credit information users; and "credit rating" means the rating of the collected personal credit information by a collection institution according to its rating standards (Article 3).
Main contents: According to the Measures, approval must be obtained from Shenzhen City's People's Government and the People's Bank of China Shenzhen Central Branch if any entity wants to engage in a personal credit information collection and rating business (Article 5). The city government shall set up a personal credit information collection and rating regulatory committee to supervise and regulate such business (Article 6). Collection of personal credit information other than that disclosable under the law shall be subject to the consent of the person concerned and such information shall be limited to the scope specified in the Measures (Articles 7 and 8). Information providers shall be responsible for the truth of the information provided (Article 9). Standards of personal credit rating shall be reported to the city's personal credit information collection and rating regulatory committee for approval (Article 10). Personal credit information collected by a collection institution shall be made available for inspection by the person concerned and the person concerned may request correction of any errors in the information (Articles 15 and 16). Collection and transmission of personal credit information over the internet is prohibited (Article 21). Anyone who discloses personal credit information in breach of confidentiality obligations or misuses or tampers with such information shall bear the civil liability thereof (Article 22).
