Applicability: The Provisions do not apply to sale of public-owned premises pursuant to housing reform policies or prices (Item 14).
Main contents: According to the Provisions, commodity premises shall be sold as a suite or unit and the commodity premises sale area of a suite or unit shall be the sum of in-suite or in-unit floor area (hereafter, in-suite floor area) and the share of the common building area that attaches to the suite or unit (Item Three). In-suite floor area shall be the sum of the in-suite usable area, in-suite wall area and balcony floor area, as defined in the Provisions (Item Four). The common floor area of a building shall be shared by the suites benefiting from such area (Item Five). The Provisions specify what areas should be, and what area should not be, considered common floor area (Items Six and Seven). The common floor area that a beneficiary suite shall share is determined by a sharing factor that derives from dividing the total common floor area by the total in-suite floor areas of all suites (Item Nine). A commodity premises sale or presale contract shall specify the commodity premises sale area, shared common floor area and the location of the common areas (Item 11). Where the shared common floor area cannot be finalized due to partial completion of the building, a pro forma commodity premises sale area may be applied to the contract provided the purchaser shall be entitled to a refund if the actual shared common floor area is reduced upon completion of the building (Item 12).
