Main contents: The Provisions list the basic conditions for an enterprise to apply for express customs clearance. These conditions include being able to provide adequate security for its economic obligations associated with express customs clearance, its products being recognized as high and new technology products, having import-export rights that are registered with customs, and having annual exports of over US$100 million in value (Article 2). If its application is approved, the enterprise shall execute in favour of the relevant directly governed customs a Guarantee for Obligations in Express Customs Clearance, which shall be filed with the General Administration of Customs and the Ministry of Foreign Trade and Economic Cooperation (Article 3). The enterprise will then be eligible for express customs clearance, which means that customs clearance of the enterprise's imports and exports will be generally based on the credit of the enterprise and that customs will normally exempt its goods from inspection (Article 7). According to the sample filing application and approval form and the sample guarantee attached to the Provisions, express customs clearance measures include advance customs declaration, online customs declaration, expedited customs clearance, expedited customs transfer, off-site release, bonded release and online administration for processing trade.
An enterprise that meets all the specified conditions but whose exports total less than US$100 million may also apply for express customs clearance if it needs such treatment due to special circumstances. Its application will be approved on a case-by-case basis.
