Interpreting authority: State Administration for Entry-Exit Inspection and Quarantine
Applicability: The Provisions are applicable to the certification and administrative work in respect of the application, review and registration of country of origin markings (Article 2). For the purposes of the Provisions, "country of origin markings"includes country of origin marks and geographic marks (Article 4).
Main contents: According to the Provisions, country of origin markings are subject to certification and registration by the inspection and quarantine authority (Article 6). While application for registration is voluntary, only registered country of origin markings are protected (Article 7). Protected country of origin marks may be afforded certain conveniences in respect of inspection, quarantine and clearance (Article 8). Both domestic and foreign entities and natural persons may apply for registration of country of origin marks (Article 11). When an application is approved, the registered country of origin marks will be listed in the Protected Country of Origin Marks Products Catalogue (Article 13). To use "Made in China" or "Manufactured in China" as country of origin marking, an export must either be a wholly original product obtained in China or, if it contains an imported element, it must comply with the requirements of the PRC, Country of Origin Rules for Export Goods (Article 14).
