Applicability: The Provisions are applicable to the invitation and submission of tenders for construction projects to be undertaken in Sichuan Province (including survey, design, construction, supervision of and procurement for such projects) (Article 2).
Main contents: The Provisions set forth detailed provisions as to what kind of construction projects are subject to tendering (Articles 8 to 14). These projects include major infrastructure projects, utility projects, projects for the construction of buildings and projects funded by foreign governments or international organizations. Procurement beyond specified threshold values for such projects is also subject to tendering (Article 15). The method of inviting tenders shall be pre-approved by the approval authority for the project concerned (Article 19). Invitations of tenders may take the form of public invitations of tenders and private invitations of tenders, and the procedures for each of them are set out in the Provisions (Articles 21 to 28). Invitations of tenders may be conducted by the tender inviting entity itself or through a tender invitation agency, and the Provisions contain procedures for self-conducted tender invitations and agency-conducted tender invitations (Articles 30 to 36). The Provisions also prescribe the procedures for the submission, evaluation and opening of tenders and the awarding of contracts (Parts Four and Five).
