Applicability: These Regulations are applicable to the production, distribution and administration of coal in Shanxi Province (Article 2).
Main contents: The Regulations set out the conditions and the procedures for the establishment of any coal mining enterprise in the province (Articles 10, 11 and 12). If a proposed coal mining enterprise is a foreign investment enterprise, will have an annual production capacity of over 600,000 tons, will operate across provincial boundaries or be located in a mining area under State planning, it is subject to examination and approval of the State level coal administration (Article 14). Other coal mining enterprises are subject to the examination and approval of the provincial level coal administration (Article 12). An approved coal mining enterprise will be issued a mining permit by the department in charge of State land and resources, but before it can commence production it shall also obtain a coal production permit from the provincial coal administration (Articles 12 and 18). Moreover, without a separate coal distribution permit, a coal mining enterprise in possession of a coal production permit can only sell its own production (Article 33). Coal distribution permits are issued by the provincial economic and trade department (Article 34).
