Applicability: The Measures apply to the capital construction and technical upgrading of water transport projects in the PRC. "Water transport project", for the purposes of the Measures, include port projects, navigation channel projects, navigation marks projects, navigation traffic facilities projects, ship building and repair facilities projects and installation, support and auxiliary projects therefor (Artie 2). Where national security or State secrets are involved in a project, or where the project is part of a disaster relief or poverty relief effort, it may be exempt from bidding (Article 53). Where a project is financed by international financial organizations or foreign governments and the financing parties have provided for different conditions and Measures in respect of invitation and submission of bids, such provisions shall be complied with unless they are contrary to the public interest of the PRC (Article 54).

Main contents:
The Measures provide that an invitation for bids must be carried out if a water transport project has a contract value of Rmb32 million or more, or is part of a project that has a total investment value of Rmb30 million or more (Article 2). In any invitation for bids, the proposals, documents and qualification examination results shall be examined and approved by the administrative department in charge of communications and the bid evaluation reports shall also be filed with such department (Article 8). Measures for the invitation for bids, examination of the qualifications of potential bidders, submission of bids, and opening and evaluation of bids are set out in detail in separate parts of the Measures (Part Two, Part Three, Part Four and Part Five).
