Applicability: For the purposes of the Regulations, technology transaction means such transaction activities as technical development, technology transfer, technical consultancy and technical services (Article 3). Application for recognition and registration of a technical training contract or technology intermediary contract may be made by reference to the relevant provisions of the Regulations (Article 40).

Main contents: The Regulations provide that parties to a technology transaction shall enter into a technology contract (Article 16). The parties may apply for recognition and registration of the technology contract pursuant to the Administration of the Recognition and Registration of Technology Contracts Procedures and the Regulations, and if their application is successful, they are entitled to preferential treatment provided under the Regulations (Article 17). Such preferential treatment includes total amortization of the payment for the technology, allocation by the technology supplier of up to 40% of the proceeds from the technology transaction or by the technology purchaser of up to 30% of the increased profit attributable to the technology to reward the relevant persons, and preferential tax treatment (Articles 31 to 33).
